A headline in Today’s, Daily Ridge reads, “8 Polk County sexual predators and offenders arrested for failure to comply with Florida law”. We had to read the story to check out what horrible new sex crimes these guys were committing and, as expected, these were not new sex offenses, but technical registration violations.
Worst, of the eight arrests, five (yes, 5 of the 8) were individuals who lived at the same address who were all charged with failing to report a vehicle.
So five people, all living at the same address, all getting charged with failing to register a vehicle… We had to look into it.
With 5 registrants all living at the same address (and it not being a high-rise condominium), it was unlikely that they purchased a fleet of vehicles and collectively decided to evade registration. It sure smelled like someone new moved in who had a vehicle and they all got popped for failing to register a new guy’s car.
According to this press release from the Polk County Sheriff’s Office, one of the guys only moved there last week!
We always wanted to challenge the “vehicles owned” change to the registration requirement. Not only for situations where roommates change vehicles beyond the control of the registrant (yet triggering a registrant’s registration requirement), but also because individuals whose cars don’t belong to a sex offender should not have their cars on the sex offender registry.
This mass arrest provides an opportunity to bring this challenge in the context of a criminal charge (where the accused have the right to be appointed an attorney).

As a former Polk County resident I personally know the horrors of dealing with Shady Grady. The sad thing is as of late 2018 you now have to pay to be on the registry in Polk County. Every time my husband goes to Bartow to register you have to pay them $5 or else they will not do your registration and you will be arrested to not registering. (unless you are deemed indigent)
I personally know the pains of vehicle registrations. My husband is 100% disabled and he can not drive because he is blind (he doesn’t even have a drivers license) But I have to have my vehicle registered and when my brother and sister in law come down to visit Florida they stay with us and we have to register their vehicle also as it is on our property and my husband has access to it. And once they leave Florida we have to go back to Bartow and inform them that the vehicle is now gone. I thought that this was crazy but I checked with a deputy I know and he confirmed it. (you have to report ANY changes no matter how small and if a vehicle is on your property for more than 5 days you have to register it in Polk County).
Now because he on the registry from a crime that happened back in 1988 (he was on probation when the laws went into effect) his life is a living hell. I want to travel and see some of the country but when he mentioned this to the sheriff’s department they said that he would have to go in and give them the date he was leaving and the date he would return. And he had 48 hours after his return to check in with them to let them know that he’s back. (plus pay $5 for each interaction)
He was also told that he would have to let them know what hotels we would be staying at and we may have to check in with the sheriffs department in those county to see what their restrictions are and he may have to register the hotel’s address with them if we are there for 3 or more days.
The sad thing is now people convicted of sex offenses can plea bargain with the state to avoid ever being on the Registry. One of the most famous cases is that of Former Georgetown Police Sgt. Jimmy Lewis Fennell Jr.. He was aware of the registry when pleading and had the option to adjust his plea deal. Everyone convicted prior to the law coming in did not know that the registry was coming so they had no chance to negotiate a plea deal to avoid the registry. They say that being on the registry is not a sentence but the Fennell Jr. case should show that being on the registry is A SENTENCE seeing he was able to make a plea deal to avoid it (during his sentencing)
I just had my 3 month check done. The cops are pissed because THEY have to come to ME, instead of me going to the courthouse.
(I was BANNED and trespassed from the Broward County courthouse because I am a “Liability and a fall risk”)
At my registration I asked the deputy if I still am on “probation”? She stated the obvious, NO, I wasnt.
Then I asked her this……
“If I am not on probation, or any legal holding, then why do I have to fill out this crap paperwork”?
And what happens if I refuse to “COMPLY” with this??
She told me that it was part of my “sentence”……
(which it wasnt)
So, I told her that even tho I have been off probation since 2000, I am still on paper/probation.
She said “YUP”

This paperwork gets scanned and sent to FDLE. If all of us were to sign these papers like I did (especially if you are off probation) it lets them know that YOU KNOW the law and what they are doing is ILLEGAL !!
As registered citizens it is important to know the laws and let those in authority know that we know the laws. It may ‘piss them off’ but it will get a message across. Law enforcement in some cases needs to spend more time polishing their ‘jack boots’ and less time harassing citizens who are trying to live decent lives.

As you should have to register where ever he goes. A sexual crime is a very serious offense. Also if the crime was rape, on a child… I don’t think the offender should see the light of day again. The fact that the Judicial system is bargaining with somebody who did something so horrific is in my opinion EVIL. They will release a child rapist “not referring to your husband”, bc I’m not sure of his charges, but let them go for their benefit and risk another child’s life? This is perverse and unjust at its best!!! I was sent to prison at age 18 in Polk county Florida for being in possession of 4/10ths of meth. Which I didn’t know what that was until I moved here. These are drugs consumed myself by choice. MY CHOICE. Why are so many being locked away for 10 years and baby rapist’s are walking around our neighborhoods? I’m sure these people are also given name changes as well. I’m sure it’s unparallel, but nobody wants to stand up. I have a feeling this has been going on for a LONG time. I actually think it’s effected some of my close friends that were victims at an early age. Question: He you ever seen a grown man shake violently in his sleep? Flailing and speaking in things you cannot understand? I would hate the day anyone who loved their children as much as I did find something out like that. Maybe why people come up missing or freak out and shoot up a school. Or maybe even do DRUGS. Because they’re dealing with something unimaginable and are forced to live with it. It’s disgusting. God will be returning soon because unfortunately this mess is to big for us to clean up now. I’ll be praying for the world and doing what I can in the mean time.

Some observations:
Went to prison at 18 for a meth charge. Did you come up with the idea to abuse drugs all by yourself? Not likely… there were adults in the equation that led to your arrest. Do you view them as equally evil as child abusers? Perhaps you may also have been an influence in a minor’s drug addition, but we won’t go there. Drugs can destroy lives as much, if not more, than sexual abuse. Google “overdose deaths in the US” if you still believe the “drugs aren’t that bad” myth. Since you also brought up God in your post, don’t deceive yourself into thinking one class of sin is more worthy of condemnation than another. A lot of people will end up in hell wondering how they got there. Don’t be one of them.
The “other vehicle” requirement essentially causes the innocent owner of said vehicle to essentially be registered and forced to comply by threats to other people in the home. That’s not punishment for associating with registered offenders. Not one little bit, I tell you. LOL

This is crazy, The Sherriff in Polk county will not rest until he has everyone who has our designation behind bars. I stayed in Polk county once for work and was there on Monday – Friday in a hotel and the police busted my chops not only to register, but they interrogated me about my intentions and why I was in Polk County. They made me move to a hotel outside of the county limits which caused me to lose my job because the hotel i had to move to was twice what my boss was paying for the other hotel. When you register in Polk county it’s like being placed in jail. I was stuck in there for over 3 hours and I was finished with my registration. When I asked officers to let me out they said no, and made me wait. I was held against my will and was only there to register. They treat everyone like they are garbage and the police are God’s gift to the world. They were very nasty, and I feel bad for what these people are going through. Polk County is probably one of the worst counties to live in beside Dade county. It’s amazing that we all have a voice but cant get this state to let us have our right to vote back so we can do something, but unfortunately, we have all been branded by Florida and society as monsters, but I keep hoping and praying that one day it may be easier for us, because bad things happen to good people, not all of us are the same. We have all paid our debt to society but yet we are still paying with our lives.

Just a side note in reference to the pdf document: arrest does not always means having handcuffs placed on your, and false imprisonment does not always mean being detained in a jail cell or detective’s office. There are MANY other instances where you may have legal grounds to sue for unlawful arrest and false imprisonment. Know your rights and NEVER talk to police!

Also having to register including vehicles and following all the other hundreds of rules required for RSO is definitely punishment. If it wasn’t you couldn’t be charged with a crime for non compliance,very simple. When is someone going to be able to run it through the system contesting it?
I don’t understand how they can justify these arrests? I live in a duplex, there are several homes on the same property with the same owner. Now according to what this arrest indicates I should as a person living on the same property have access to all of their vehicles. Wow what a stupid way of looking at it, I have access to MY vehicle and only mine. No I’m not an offender, just a person with some common sense. I see how maybe they could arrest the owner of the vehicle and only him. Come on Judd you think by wasting tax payer money that you will advance further in politics.

So the cops come over to your house and give you the **feel good fuzzy orange pumpkin** to put on your door to say “no candy given here”. What happens if you go to your neighbors house, sit in a chair, and watch the parents down the street give out candy?
You need to look at your conviction date to see what you are “Grandfathered into”. Most stuff the FDLE “TRIES” to make you do, you are not required to do. I believe the cut off/grandfather date is 2007. If you were adjudicated before that date, they cant enforce laws that came AFTER that date.

For purposes of constructive possession a locked door on a bedroom is enough to exempt cohabitant roommates from each other’s belongings and establish a separate domicile for each roommate. I don’t see how someone else’s locked car in a shared driveway could be construed as being “mine”. I’ll be interested to see if the prosecutor kicks the case or not. A primary element to conviction is establishing INTENT to break a law, but that seems to all go out the window when prosecuting registry violations.
Registration violations are strict liability – intent or knowledge of the rule is not a defense.
And we’re talking about Puke County here, with Sharif Gravy Jug. If these guys are to stand a chance, it will have to be with an outside attorney. All of Puke County is as corrupt as their Sharif. The locals are all drinking from the Jug, otherwise they wouldn’t keep re-electing it.

Not good enough in Polk County. If the address of the person(s) is the same as registered in the Post Office and not actually an apartment, each person has to register all vehicles of persons who live at that address.
There is a nice owner who owns several properties in Lakeland who rents exclusively to SO/SP. There are up to 6 persons in each 3/4 bedroom unit and every time some one moves in or out, all renters must go to the Sheriffs office in Bartow and register/re-register the vehicle changes as well as who shares the home . Also, if one of the residents gets a different vehicle, again a trip to re-register. The time to register is usually 2-5 hours each time.
I speak from experience with my husband. There were 9 different trips to register/re-register at the Sheriff in Bartow for him and for the other 4 or 5 renters within 11 months. This was in addition to the semi-annual required registration for my husband.
This does not surprise us at all. The monthly check by the Polk County Sheriff at each of these homes is well known and the Sheriff counts ‘calendar’ days as they are open all day and night including holidays
We are thinking of collecting for a lawsuit that would challenge the IN PERSON registration requirement. I will announce it and see if there is interest.

THAT is the SINGLE Most BRILLIANT Idea that I feel would have the overwhelmingly majority of winning. Give them the registry and take away the ridiculous time consumption that would allow for far too many technical defaults to the law. This would save time and money for all involved and make it so the law can actually be upheld. In Kansas they mail you a form every three months ,you check the box’s and sign and mail back. You have ten days to return the form.when I lived there I thought it worked well.
David M, Florida finds it difficult to intimidate through the mail. Besides, it helps to keep people off the welfare roles by hiring them as probation officers.
The difference is Kansas isn’t an ultra rich state anymore as it once was. So they have decided to use there money wisely. I’m sorry, but it sounds like all the counties south of the Ocala area/Marion Co are just ridiculous when it comes to sex offender registration nonsense. If at all possible, I would just suggest moving more north. While Jacksonville/Duval Co is not perfect by any means, for the most part, I’ve been able to live my life with little interference. I haven’t had a detective come by my house in over a year now. The last time I went to register, it was in and out in 30 mins. We have to make an appt, so they’re obligated to see us quickly. And the last detective and I sat and talked for about 15 mins. He asked me about my situation, off the record he said, and basically encouraged me and not to get down about my life and situation. In short, he gave me a spiritual message which I know a govt employee is putting himself at risk for doing, but I didn’t mind it at all. Hell, it shocked me to be honest. So yeah, Duval Co, Clay Co, St Johns Co, all seem to have positive reports from people I know that live there. Just a thought for all you “Southerners” that are suffering down there. I know moving and relocating is hard to do, but if it gives you some relief, it wouldn’t hurt to look into it.
Sounds like some in law enforcement in Northern Florida are doing what they should be doing…helping law abiding ex-offenders get back into the mainstream of life. Unfortunately so many have a “Hitler” syndrome and would prefer to see RSO’s sporting a scarlet “S” and confined to a re-education center…complete with ‘ovens’. Based on the ‘thermodynamics effect’ I wonder how many of these staunch defenders of safety have something in their backgrounds to hide…by bashing those who have come out into the light and accounted/paid for their failures?

I was just talking with my significant other a few days ago about this. In what pee-brained mind are these politicians justifying putting a non-registered citizens vehicle on the registry is a BLATANT Constitutional violation. See excerpt below:

So at what point does this backwards State realize that it is wrong???

If anything this should be a violation of the rights of the people who haven’t done anything wrong and have to have their information registered. I have two roommates that have cars registered who have never been arrested for anything really, and now when their plates get scanned by passing cops well….guess they’ll get harassed too??

If my mother comes to visit I have to register HER car as that of a sex offender. Then I have to go to the sheriffs office AGAIN when she leaves. This is absurd. Living under these conditions creates such a myriad of unintentional ways to make mistakes. And just when you think you’ve got it figured out they change the rules again, making it even more difficult to stay out of jail. For what? And to what end?
With this kind of legislation we would all be better off if they were all just fired and we were represented by a “puppy”. We would have better representation. These are laws made up by legislators who have nothing positive to contribute to society.

Interesting that someone should bring this up. In Jacksonville they keep a list of all vehicles at a residence, but DHSMV only pushes those vehicles actually registered to the RC to their FDLE “flyer,” from what I can see.
I would like to think this is out of concern for family members and co-inhabitants, but that may not be the case.
DHSMV bases it on whose name is on the title.
I have a roommate who was a Security Guard. (she is now disabled) The BSO (yes, Broward Sheriff Office) told me/her that she HAS to register her car with the FDLE as a “Sexual Predators Vehicle”, even tho I do not drive the car. IF she were still employed she would have been FIRED from her job as her vehicle was listed to a RSO/Felon. This would be an innocent person, who has committed NO CRIME and is being punished, and LABLED as a Sex Offender. She would have lost her job, her Security License and her freedom because of this stupid law.
I have also found out that the FDLE website is printing out false information. My adjudication date was 2/26/1995. They have it listed as 7-17-1996. By listing THAT date, they had me listed on their website. They had changed the law in Dec 1995 as far as people on the website.
I also have found out that I fall under “grandfather laws” which means that (according to BSO Deputies and “Career Criminal Deputies” [this was my first arrest ever] I am allowed into parks, I own my own home and have never been arrested since.) Basically I was set-up by my ex-wife.
There were 3 Deputies who tried to mess with me. After IAB investigations; one Deputy was fired, one transferred out of the County and the 3rd was busted from Detective Lieutenant down to road patrol.
A sex offender must report his or her registered vehicle…but not every single vehicle he or s
he so happens to be in. This is an arrest that can be successfully challenged. Polk county has always been one of the most severe when it comes to dealing with sex offenders.
According to Florida Statutes: “Vehicles owned” means any motor vehicle as defined in s. 320.01, which is registered, coregistered, leased, titled, or rented by a sexual predator or sexual offender; a rented vehicle that a sexual predator or sexual offender is authorized to drive; or a vehicle for which a sexual predator or sexual offender is insured as a driver. The term also includes any motor vehicle as defined in s. 320.01, which is registered, coregistered, leased, titled, or rented by a person or persons residing at a sexual predator’s or sexual offender’s permanent residence for 5 or more consecutive days.
So… you get a visitor for more than 5 days, you need to register THEIR vehicle.

All I want is one of these idiots to explain to me where these laws prevent future crimes in children??? That’s all I want.. everyday on the news I see new crimes but there not guys on the registry committing them. It’s law enforcement or teachers or military personal. So how are these laws preventing anything. It’s like saying stricter gun laws will prevent shootings!! It’s not gonna happen.. These laws are clearly unconstitutional but we don’t have a big enough force to fight with.. like look at the NRA as soon as gun laws came out they sued the state of Florida for the unconstitutional laws. But we will never have the funding that the NRA has or this would all go away.. on the news today a lady is pushing for a new registry for child abusers.. they are saying it will be like the sex offender registry this should be interesting!!!
