					<description><![CDATA[Alabama does not like being told what to do by the Federal Courts and still disobey their rulings on a lot of cases from the 11th Circuit and SCOTUS rulings.
Watch what happens a judge won&#039;t change his stripes and obey the ruling.
Many cases get overturned but they get re sentenced illegally because their is no oversight in the local courts. They will find an excuse to enforce their ruling.]]></description>

Wonder what this says for the states presumption that USICS can automatically refuse a RSO from sponsoring or having their from another country live with them simply based on being an RSO? I am not really in a hurry to return to stateside because third world country&#039;s have far better freedoms but it would be nice to see family again some day.,]]></description>

The bad side is that there were actually dissenters on the Court for an issue that should be unanimous. One of the dissenting opinions even cited an extraordinarily low recidivism rate for people convicted of possession of child pornography. The haters don&#039;t let real facts get in the way of their preconceived ideas.]]></description>

Instead, it remanded it for further proceedings, and the dissent actually found that the law survived strict scrutiny and would have upheld it as written. Unfortunately, the dissent in Henry still leans on McKune v. Lile, the same discredited source that claimed sex offenders are far more likely than any other offender to reoffend, a statistic, as we know, traced back to a 1986 Psychology Today article, not peer-reviewed research. That battle has to be fought in a case with cleaner facts.]]></description>
