in 2007 the US Supreme Court decided Kimbrough v. United States, 552 U.S. 85 (2007), which stated the Federal sentencing judges could use the sentencing guidelines as discretionary. The case concerned sentences for crack cocaine.
It still won&#039;t overcome mandatory minimum sentences, but it was designed to help a criminal defendant whose judge didn&#039;t feel they deserved the sentence they were given, but the sentencing guidelines dictated the severity.
You will need to speak to this person&#039;s criminal attorney to see if there are any opportunities for post-sentencing relief.]]></description>

					<description><![CDATA[Some of this either goes over my head or it is purposely ambiguous  lol   reading it I was not sure if the article was saying CP viewers and possessors are dangerous or not dangerous - also this particular crime (especially in this digital age) is based on the belief that viewing the porn is the same as re victimizing the victim.  Personally I think that is bunk (I know not very politically correct) - but if we are going to drink that kool-aid then we have to also conceded that looking at the photo of a murder victim makes us a murderer. - most would concede that is ridiculous - there is also a school of thought that possessing or viewing CP leads to contact crimes and there is no evidence at all to .support that assumption any more than there is that watching a slasher movie would lead us to become a serial killer.]]></description>
