In this instant case Karen, the relief only applies to the 3 who won the case. It was an “as applied” win. Meaning it was applied to only these 3. If it is appealed to the 10 Circuit and upheld, then the relief would apply to those living in the states who are in the 10 Federal Circuit i.e. District of Colorado, District of Kansas, District of New Mexico, Eastern District of Oklahoma, Northern District of Oklahoma, Western District of Oklahoma, District of Utah, and the District of Wyoming.

Lets say it lost in the 10th for this example.

If the 10th Circuit reversed the Colorado ruling, then it would be appealed to the Supreme Court (SCOTUS). If granted certiorari, then SCOTUS would hear the case like they did in Pakingham. If the 10th Circuit ruling was then reversed by SCOTUS, the AWA would be out the door, and all RSO’s across the United States would win.

Right now it’s a good case that sets a precedent that other courts can site as well as follow.
