The other question that comes up here is how are the files being accessed by LE? The software they use to look for users with CP has always been questionable. In my sons case he was adamant that his sharing was turned OFF - when he was arrested the LE even asked him explain to us how you know to turn it off and how do you do that? Official forensics were never done on his equipment and personally I believe one reason is because they knew those forensics would show his sharing was turned off. They did not charge him with distribution (of course they threatened to) but then it is a question of whether the intrusion on his computer was illegal? Personally I believe it was

Actually both court decision are correct. So what distinguishes them?

The presence of the file-sharing program without connection to a site containing CP does not violate any law, but connection to a site with CP (whether or not one downloads it) would violate the law. Study the two cases.
