Ex post facto is not unconstitutional. Ex post facto PUNISHMENT is. And we have to overcome 18 years of bad case law that says that registries don’t pass the balancing test for punativeness. We believe today’s Florida registration scheme easily fails that test.

The lawyers that filed the suit believe that the court incorrectly applied the statute of limitations here. But in the event that the circuit court of appeals disagrees with us, the lawyers have filed ANOTHER suit in which the statute of limitations is not a factor anyway.

Which is Ex-Post-Facto ??? There must be something I’m not understanding. Did the Lawyers that filled the suit know about statue of Limitations? If not why? I bet the statue of limitations was Ex-Post-Facto also.
