I’m talking about applying the post 2005 residency restrictions to persons who were convicted prior to that date. Clearly, any older conviction that was subject to the residency restriction rules consider those residency restrictions to be punishment. How do we know that? Because it was a special condition of probation that expired upon termination of probation. Conditions of probation are punishment, not “ministerial actions”
