Please realize that most responders here are convicted Citizens that decided to take a Plea Deal; they may have never committed a crime but they had no way out as they were most likely threatened by over zealous prosecuting attorneys……….take a plea or spend possibly 30 years in the Brink!

Yes there is no guarantee that the spouse can come to the US. That was established using a situation that the spouse was the problem not the citizen.

My bigger concern and why I feel like it should be considered ex-post is the wording specifically removes the offenders ability to apply. That is something all citizens can do but in this case we can not. We have to apply for a waiver to apply. And the waiver is pretty much impossible to meet the bar of no harm.
