We just got word that the Judge denied the plaintiff’s request for an emergency injunction.
The news is disappointing, but not surprising.
The plaintiffs were hoping the judge would enjoin the enforcement of the Bovo amendment, preventing the 270+ individuals homeless at the encampment in Hialeah from being arrested. He did not.
Attorneys are evaluating next steps. In the mean time, where these 270+ individuals will sleep tonight remains an unknown. We will just have to see where the next encampment pops up.
You can bet this so-called Judge is on Rahn “the nanny” Crook’s donation list.
He was.
He received $1000 from Book, though I doubt $1000 swayed his decision.
$1000.00 is a good payday for one word, DENIED. Probably with the promise of re-election and more campaign contributions. I just knew Teflon ron had his grubby little fingers in the pie.
I think the judge realized that the problem would not be fixed (until/unless) the Executive Branch=Dick Scott and the Legislative Branch=Florida Politicians in the House and Senate stopped making bad laws and policies against our community.
The judge also saw the encampment as a heath hazard.
While I would not ever claim that the judge would not consider his political career in this decision, I can (and do) see his point of view from a judicial stance.
M – Respectfully, I do not agree – there is plenty the judge could do. He could find the living restriction unconstitutional – he could have ordered the county to find a decent place for these people to live – remember these folks were told to go there by POs and LEs because there was no where else to go. Other judges have done similar things. No, there was plenty the judge could have done.
It’s ok that you disagree. I just happen to know the limits a judge has on legislating from the bench. I also reiterated why the judge gave his decision the way he did.
I do think that he could have granted the injunction, but it would not have solved much other than to delay the Bovo Amendment which was being pushed by (insane man) Ron Book. What needs to happen is the Florida legislature needs to stop making bad, unconstitutional laws. That fight needs to happen in the Federal courts where a person’s political career does not come into question.

The worst part is the truth that some of these people, like people charged with other offenses, have been unjustly accused – Fl is not the only state to have corruption, there are others. All u can do is pray the Lord intervenes. Why do I have to live in Ocala with a known wife murderer walking the streets, have to put up with chronic sexual harassment just trying to work, put up with people trying to steal my identity to get my social security and my husband, people cloning phones, people stealing anything they can get their mits on, older people living in fear because the thieves are about – the druggies, the drug dealers, etc. etc.
More than once I have been stopped when walking to go get medicine, etc. only to get stopped by some dirty old man looking for a hooker – its pathetic. I have put up with petty theivery, people breaking into my car to steal tools, stealing clothing, stealing food the minute ur back is turned – and they get away with it , some of them because they have friends in gov’t positions. Several years back their was a man who killed a woman and her daughter when he was driving drunk. He got off for some lame excuse and I , working at a cemetery at the time, had to watch the father/husband crying over their graves – they were just on their way to work. All because the drunk was well connected. Welcome to America.

The Florida legislature could easily fix this problem by doing what some other states have done: pass legislation overriding all city/county residency ordinances. But, then again, as long as Florida remains under the control of Republicans, that will never happen.

A two year probation completed in 2002 , ruined my 40’s now my 50′. From my experience, forget it, pack it up, close up shop. I can’t make ends meet anymore. From here it’s uncompliance, prison, then death

Nope – very predictable considering that there is no regard for the constitutional rights in Florida and the abuse of American citizens who have paid their debt to society are never allowed to move on or have a second chance.
These individuals are being systematically eliminated one way or the other in Florida via these never-ending cruel and unusual punishments.

I have a question as well as a “Fix” about this law !!???. Since we’re ALLOWED BY LAW to travel ANYWHERE in the USA as long as we don’t stay in one place more days than that State says we can before having to “Register”, Why can’t many of these people at the encampment do just that !!???. Sleep in there Vehicles or Tents at this Walmart one or 2 nights, Then behind a Circle K the next couple of nights !????. Atleast long enough to figure out what in the heck the County and State is going to do ??. I understand that the “City” passed the “No overnight camping” law, But in reality, Couldn’t everyone get together and Buy a couple School Buses and convert them into Sleeping Bunks and simply park somewhere OUTSIDE of the City each night ???. Or maybe rent a RV space and park the Buses there ??. I mean, We (Especially those living together at this Camp) need to BAN TOGETHER to fix this problem right ??. The “LAW” here in Florida says we’re ALLOWED to travel, Well use this “LAW” against the City/County/State !!!!!!. I hate that these “HUMAN BEINGS” are being treated like this !!!. And wish I could do more !! I’m already speaking out about all this “ILLEGAL” stuff being done to us !!. I’ve given away “Camping” stuff to EXOFFENDERS that I’ve met that don’t have anything !!.
