Jed, There are declarations from individuals harmed which were filed under seal.

It’s true that defendants commonly seek dismissal before it gets to court, employing the arguments they believe are available to them.

In my opinion you can’t just name a vast group of people who are harmed, without specific details of each persons harm. courts want specific harm by individuals from what I have witnessed.

Don’t get me wrong, I am an PFR and applaud the lawsuit. I am worried about a dismissal before we even get to see a courtroom, as have many in the past been dismissed due to lack of harm shown.

I pray I am wrong, but we will see what reasons the defendant uses for his dismissal petition.

The complaint lists the damages suffered by FAC’s members. The statement, “judges will try to find any reason possible to dismiss this case,” is not accurate.
