I was in the Alabama DOC for 10 years straight. I spent the first 5 1/2 years being moved from prison to prison to stop my court cases or helping other inmates. Four were private prisons and each one tried illegal acts I challenged and they would moot the case by shipping me to another one. Mooting a case means there is no chance it will happen to the plaintiff again.
Every one who filed got shipped to another prison.
My argument to the Federal court was "How can a policy to deny become moot if it affect the same class or group of people and not just the one plaintiff?"
We got sent back to ALDOC and they were forced to release inmates on early release to make room for us. 2007
There are plenty of cases where challenging their profit as a business. Not using criminal law but Business, Civil, and Constitutional Law.
And if they do not have a Law Library then by law they have to provide you with legal assistance outside the prison. But you must request this through a 42 USC§1983 form.
In the first private prison which was CCA, the ALDOC Commission had a money connection to CCA. He was a stock holder.
The warden at the prison was a former Warden in the ALDOC and a sex offender convicted of sexual harassment in Alabama and failed to disclose this to CCA. This was in 2003.
So know who the defendants are and their background may help your case if you are stuck in a private hell on earth prison.
