The United States government has commended the Bureau of Immigration (BI) for preventing 200 American registered sex offenders (RSOs) from entering the Philippines in 2018.
Immigration Commissioner Jaime Morente said Friday the bureau was recently awarded a certificate of commendation by the US Embassy in Manila after registering the second highest number of excluded American RSOs throughout the world last year.
Mexico, which shares a land border with the US in the southwest, recorded the highest number of intercepted RSOs.
“I commend our officers deployed at our ports of entry for a job well done. Because of your vigilance and alertness, you were able to turn away these sex offenders to protect fellow Filipinos from possible exploitation,” Morente said in a statement.
The US Embassy’s citation specifically commended the BI’s port operations division (POD) as well as the airport operations section (AOS), travel control and enforcement unit (TCEU), and border control and enforcement unit (BCIU), which are all under the POD, for successfully implementing the “Angel Watch” program in the country’s ports.

U can get a I-130 visa but approval 98% Denial and getting back in no chances your other option is HK u may get stopped but usually lthey will question u and send u on your way let them know your wife is at the hotel in airport very rarely have I seen then deport. I am Marjorie Dempsey and I am a judge in the Philippines. I’m married to a registered sex offender
for ten (10) years now. Before I married him, i already know that he is in the registry but that did
not dissuade me from marrying him.
The Philippine Constitution has been patterned to the US Constitution because the Philippines was
once occupied by the United States of America. The Philippines adopted the US Constitution
because it is the better one among that of the Spanish or Japanese Constitutions. Although we
don’t have a registry of sex offenders, said registry is unconstitutional in many aspects.
1. It is an ex post facto law because it increases the penalty after the crime was committed. In the
case of my husband, when he was convicted in 1997, the registry was not yet in effect. Thus after
serving time in prison, and out on parole, that should be the end of it. However, in 2006, with the
passage of the Adam Walsh Act, he was required to register quarterly for a lifetime. This violates
the rule against retroactivity of laws. What is worse, several laws of similar import has been passed
throughout the years which inflicts graver restrictions and added penalties. Every time a new
penalty is added on top of the already served sentence, it creates a new sentence. This is punitive
plain and simple. The accused who have already served his original sentence will never be freed
from his sentence because of the change shifting penalties. Retroactive application of laws should
only be allowed when it would benefit the accused, consistent with the Pro Reo Principle.
2. It is violative of the Due Process Clause. By due process, an accused should be afforded all the
information regarding the crime he committed at the time it was committed. At the time my
husband was charged, the penalty was imprisonment for a given number of years as defined in the
law violated. Armed with that knowledge, it aided him to admit liability. With the
subsequent passage of the Adam’s Walsh Act, it imposed an added layer of penalty that was not in
the charge when the plea was made. Thus, in order not to violate the due process clause, only those
accused at the time when the penalty included being in the registry who should be bound by it.
3. It violates the Equal Protection Clause. Subjection to lifetime registry for sex crimes but not on
other crimes which are equal to or more severe than sex crimes unjustly puts the former at a great
disadvantage, something that is frowned upon by any democratic institution. For instance, a person
convicted of urinating on a tree in a park is much more severely punished that that of a person who
assaulted someone because the former bears prison time and lifetime registry as against the latter
where the person after paying his dues to society can enjoy his freedom unimpeded.
Because of the cruel restrictions imposed by the registry requirement, my husband has been denied
being a father to his two daughters, a grandfather to his grandchildren. Likewise, my son is robbed
of being with his two sisters and their kids.
Okay if you’re supposed a judge in the Philippines what avenues are there for us US citizens to file a motion to be able to enter the country.
I know you can do this with mexico since it violates the Mexican constitution. You can create a legal case once you’re denied in the country. What avenues are there for the Philippines to challenge this?

The bill would also give additional tools to law enforcement agencies to go after Filipino and foreign sexual abusers of children. Any sex offender convicted overseas would be blacklisted and would be barred from entering the Philippines.

I’m not sure, but I do know that the Philippine Government does apply their Laws Differently to Natural Born Citizens Than Aquired Citizenship or Foreigners depending on which Law. But I think as long as your wife’s Philippine passport is valid she should be ok.

I can say recently i was Blacklisted for RSO I’m not it was mistaken identity my name was the same as another person on the registry and homeland security sends a list of registered citizens inbound and who are already there so when they renew there visas you get stopped jailed and deported.

If you haven’t try to come to the Philippines, then you’re not on the blacklist yet only RSO registered who tried to enter the Philippines is the one they are putting on the blacklist but if you haven’t tried yet and you haven’t encountered the Philippines immigration in the airport then 100 percent your not in the blacklist.

What I would like to find out is if I am on the blacklist. I have visited the Philippines 3 times Before They started Blacklisting RSO’S My last visit my wife who is a duel citizen and I stayed 4 months in 2009. Currently I am waiting to petition the court for Relief of registration under California’s New 3 tier system. I am Already eligible but have to wait for my birthday in January 2022 to file according to the law. I figure it will take me at least 2 yrs to complete everything (ie. Granted Relief, Removal from registry and Internet, Record expunged, And Then Apply for new passport with NO IDENTIFIER stamp. So far the department of State has never asked for my old passport back which expired a year ago. Then my last step will be to have my wife check if I am on the Blacklist.

BI hails EO on Advanced Passenger Info system
The Bureau of Immigration (BI) welcomed the issuance by President Rodrigo Duterte of an executive order mandating the implementation of an advanced passenger information (API) system to strengthen border control and thwart the entry of terrorists and other undesirable aliens in the different international ports of entry nationwide.
In a statement, Immigration Commissioner Jaime Morente said the API project will surely boost the country’s ability to police its borders as it will add a layer of protection from foreigners with criminal and derogatory records from boarding vessels right at their ports of origin.
“This EO will surely secure our country from fugitives, terrorists, transnational criminals as well as other undesirable aliens attempting to slip into our country,” Morente said. “We are thankful to President Duterte for his continuous support, as this is a big step in improving the Bureau’s systems,” he added.
Under EO 122, the API is the electronic transmission of information by the captain, master or agent, or owner of a commercial carrier to the Bureau of Immigration (BI) prior to a traveler’s arrival or departure in a Philippine port of entry.
Such information includes flight details, name, date of birth, gender, citizenship and travel document data of the individual passenger or crew/non-crew members.
The API will enable the BI to conduct in advance security vetting of international travelers to effectively facilitate and expedite the arrival and departure process of legitimate travelers during primary inspection,” the EO stated.
Morente said the new scheme will also help decongest the airports and ease the conduct of immigration formalities for travelers because the derogatory checking of inbound passengers will already be done at the ports of origin, thus travelers who have derogatory records will no longer be allowed by the airlines to board their flights.
It would also allow them to closely monitor movement of suspected illegal syndicate members who are subjects of alert lists of international intelligence agencies.
The BI chief bared that in compliance with the EO, the BI will soon constitute a technical working group composed of representatives from various government agencies and private sector that will draft the API’s implementing rules and regulations (IRR).
“We are required to finish the IRR within 60 days so we have to convene this technical working group as soon as possible,” said Atty. Candy Tan, BI Port Operations Division Chief.
The system, she shared, is being used by advanced countries such as Australia, Canada, and the United States.
She added that the new scheme would require the Bureau to conduct advance derogatory checking or vetting of thousands of passengers who enter and exit the Philippines daily.

Hi Richard, If you Really Want To Get Married My Advice Would Be For You And Your Fiance To Meet In Hong Kong Enjoy Your Time There Take A Lot Of Photos Of The Two Of You Together, Then Any Letters You Have Keep Them As Evidence Also Any Email Print Them Out. Then When You Come Back To The US File A Fiance Petition it’s i128 Form Make Sure You ask For The Package as there are other forms that need to be filled out. There is a requirement that you must have met in person with in 2 years of Petitioning That’s what the pictures and letters are for. Everything can be done in less than a year

Jake if I were you, if you have family in the Philippines ask them to check with customs or DFA if you are on the blacklist. That’s what I had to do. If you are on the blacklist then you will need an attorney to get you removed or file a petition yourself- be prepared this maybe a long process

Put it this way and again I am
not a lawyer but know this from first hand experience so it’s best to get a lawyer like I did. If you are on the blacklist you cannot step foot in the Philippines whether you are off the registry or not. It will save you money and time if you send someone you trust to DFA to ask a copy of the blacklist letter if you are still on it. If you are not on it, it’s best you get a copy just in case you get stopped by either USA or Philippines

with that said he and his wife and child meets in HK 3x a yr, yes he does get stopped in HK but allowed to stay explaining that his wife and child are from Phils they are at Hotel XXX and waiting for him since they cant meet in Phils

Hi kaye, if your bf is a RSO his US passport will have a statement printed on the last page Stating he was convicted of a Sex Crime. It is up to the country where he wants to travel too to let him in or not. And I have not found any Country’s that allows RSO now.

DI ko alam Lorraine. SIguro sa waiver ng DFA or BI. However your husband will need a valid reason and/or connections to enter the country. You will need to get the blacklist letter and if you choose get a lawyer since DFA or BI can give you a hard time. DFA is asking me to pay 50k php to clear the blacklist so its all about money if you really the problem to resolve itself and depende ng reason for your husband visit

Yes I am a registered citizen and also have my case on appeal which my attorney is using as a reason to get the waiver lifted in my case. As far as angel watch is concerned- the US government can send an alert as many times as the want to countries RSO may go to however, its not up to Angel watch for the citizen to go through and clear customs, its up to that individual country and its law and how the run things. If they lift the waiver on me its just a one time thing so if I am reading your message right, you are suggesting every time I or someone who is blacklisted leaves the country they will get blacklisted again and have to pay 50k PHP to just get a waiver again, obviously that is not the case as once you get the waiver you can’t be on the blacklist unless you give them reason to put you on it.
My husband is been always in the Philippines every year only this 2018 he turned back to the USA due to RSO. And he also has a permanent resident card in the Philippines and we have 2 kids there that’s why we really want him to visit the Philippines..so if we’re going to pay 50k is it 100 % sure they let my husband enter?
Unfortunately Lorraine and you or your husband has to contact a lawyer to confirm but in 2018 Philippines banned all RSOs from the country whether they are from the USA, UK, Canada or any place that you have to register. Everyone case is different, I do not know your husband charges, and I don’t know what everyone else here is charged and either been convicted or had a plea deal but just because I said 50k does not mean it will apply to everyone but from what my attorney has said they will want money to clear the waiver so no not 100% there have to be other factors such as did your husband complete his sentence? Maybe the age of your children- if your children are still a minor, I don’t think it will help your case especially if your husband case involved a minor. Again I do not know your husband situation. In regards to your second question about requirements, with their being a ban of all RSO in the Philippines you will need most likely legal help as this has nothing to do with requirements. What does help is if you have children and the age of them or any connections to the country. As far as months it could be anywhere between 6-12 months however with the pandemic be prepared for it to be longer. The reason I have not finished my waiver as of yet is because my case is going through appeal and both of my lawyers suggest I wait out the appeal process before resuming getting a waiver so I don’t waste money on two attorneys. I hope this helps and sorry that I can’t answer more since I am not a lawyer but you will probably need a licensed legal help to get what you want accomplished rather than get several different opinions from the members here.

lawyer did derogatory records check, seems I was on blacklist but it has been lifted. will be getting a copy of lift letter once the lockdown is relaxed, and also will be retaining the attorney for any future immigration roadblocks appear.

for some reason this thread isn’t letting me reply to these last few posts.Anyway, I did not have to go thru any assessment. but I started the spousal visa before this international thing went thru I think. Lawyers name is Ryan Barshop, they have offices in NY, Manila, and Ho Chi MInh City, He was surprised that USCIS accepted my petition too. But I hired him anyway just in case I needed him to fight. He planned on using the defense that this was not a megans law enforceable crime. It was an internet sting and there was no actual victims really. they were police drag netting the net and posing as young girls being extremely forward and acting promiscuous and basically leading the potential perps. into committing their crimes. I’m not minimizing my part, I was wrong as the adult but I did get set up. I paid the price and learned a heavy handed lesson that will never happen again. Jake as a level 1 S.O. who got off the list more than 7 years ago you are not on the black list. I am in the same boat as you and living in Thailand and have visited Manila numerous times over the past year without a single issue. By you doing all those things like checking black lists and putting your name out there you are only going to cause trouble for yourself by putting yourself on the radar there. There is a HSI office right there at the embassy and they will even tell you there is no issue for anyone over 7 years as the records are expunged on there system as well. However, if you start blabbing your name all over the place asking for black list info etc. you are looking to get yourself singled out. If you are in Vietnam take a flight there and you will see you will have no issues. Good luck!

Not everyone on the SO registry is a threat. There are people in USA on SO registry for things such as playing doctor when they were little kids and you have teenagers who have had consensual sexual relations with each other and get caught in act and have their lives destroyed over this being forced to register as a SO. I call this Angel Watch Devil Watch! I feel these 200 people and all those on this registry need to stand up, fight back, and resist through any means necessary and defiantly enter the countries they were blacklisted from including the Philippines here and give the USA the finger. These RSOs should also tell off and shout down the lawmakers that make up these evil laws as well just as been done with some of the people in the Trump Administration by those oppossed to the Trump Administration and its policies. If I were forced to register as a SO as a child for playing doctor and were banned from entering a country as an adult, I would defiantly enter country making it clear that I was a child who did what is a natural part of growing up and should not be persecuted for it. Any attempts to make me leave country and send me back to USA would be met with resistance through any means necessary even if it meant committing acts of violence against the authorities keeping me out and against those trying to deport me back to USA. If lives would be lost through these acts of violence, so be it. To me, this would be no different then when there were resistance movements committing acts of violence with lost lives against the Nazis during WW2 in Nazi occuppied areas. This SO registry of the USA and the countries barring so called US sex offenders is no different then what happened during WW2 when persecuted groups of people fled Nazi Germany but were denied entrance because of them being Jewish, Slavic, Gypsy, etc… according to their passports. It would be thrilling to hear about a group of SOs resisting and fighting back at the authorities here defiantly entering the countries they were barred from refusing to leave. One day decades and centuries from now, this SO registry of USA and its horrors will be on the wrong side of history and future generations of students in a possible post USA society will learn of the atrocities committed in USA through the SO registry amongst many of the other horrors committed by USA both domestically and internationally. USA is a country that refuses to learn from history and is a present day violator of human rights both domestically and internationally. This SO registry is just one of USAs human rights violations.

I recently spoke to an attorney regarding this and I have started filing my case with the government. Obviously being a RSO you will be denied entry into the Philippines. That means, once you go through customs, they will turn you back to the next place to the USA. I was advise and I did obtain a “blacklist letter” stating I am blacklisted from entering the country because as of right now while I am appealing my case, I am a RSO. The only way to get removed from the RSO is to get a clearance letter from DFA in the Philippines, announcing you are allowed in the country. I have not gotten this far yet but my lawyer has advised that I will be denied at first, however after appealing my case, you may have a 50/50 chance on getting your wish but it could take months from happening. Best to file 3-6 months before you intend to travel for best result

The Biggest problem we all face is not enough money to hire lawyers who fight for us.
Google how many U.S. members of Congress have used tax payers money to settle allegations of sexual assaulted against them. And by paying off their accusers is admitting their guilt. If there are RSOs traveling abroad to commit sex tourism crimes, they, not all RSOs must be punished for those crimes. Why make everybody pay? The law doesn’t make any child safer if the RSO has turned his life around and is living a healthy and good life. And I can tell there are many, the majority of us who are living not in line with a mistake we make. The Majority of us are no danger to any minor, despise our mistakes. This law punishes the majority of people who are playing by the rules. It is destroying families. There are close to a million of us who are forced to register. But also, many of us can vote. Besides, we have family and friends, who in most cases support us and see this perpetual punishment as unjust. It is time for us to organize and send a message to politicians who constantly punish those who are doing well to make an exhibition of their concerns for children. We need to organize and make our voice and votes to be heard.

These 200 that have been listed as visiting the massage parlor in Jupiter . It’s going to be interesting to see how this plays out are they really going to be able to charge these Billionaires with any more than a slap on the wrist, I doubt it.
I’m glad to see that these young ladies are finally going to be able to be set free, But why did it take 6 months of surveillance. If young girls were stranded in there car in a river , in a flood , would you wait 6 months to rescue them. While you investigated who was responsible for the flood. Or were the investigators getting there jollies so much watching this that they let it go on for that long. Especially sense they said they knew it was going on for years. Also how many names have they removed from the list police officers politicians. Also how many on the list were on the registry? None I’ll bet, and will the 200 be put on the list? Time will tell.
I have to wonder what benefit the US government gets by having its own citizens being banned by FOREIGN countries.

I agree I am rso also and did my time. I am not a threat children either. I don’t even have a single stipulation that’s how none threatening I am to children. I’m 35 now and been last 10 years out of trouble. And I still can’t travel? I messed up before not making sure and I don’t even date anyone over a 10 year difference older or younger that’s my rule since forever. They should change rules for rso travel to at least risk assessment or something or lie detectors tests or something give rso that deserve a chance to prove they no threat and let them live there life as long as doing what asked and told. Or even if they have check in with authorities daily or weekly or something.

Want to talk about banning rap because of there mistakes or with mistakes from being lied to. Not everything is fair and yes some reoffend but not all will. It was the members of the U.S Congress who wrote and passed all the law’s against sex offenders. Go to Google and start googling Congress members changed with committing sex offences and you will find that over half of Congress has used tax payers money to buy off their victims. I m certainly not an Attorney but since the statistics show that those on the registry are no less likely to reoffend than the general population. Proven in part by the fact that by far most offenses are committed by those not on the registry. Why should not the burden of proof be put on the prosecution to prove in each case that this individual is more likely by far to injure someone than the general population before they are put on a registry in the first place. Does not the law say innocent until proven guilty , or is that just “ fake news”.
I personally know that that is what plea bargains are for is to get you to feel like your getting off easy when there trying to charge you with something they can’t prove usually because you’re not guilty, and making it sound like a good deal .

Very Sad my wife is Filipino and we wanted to travel there for Christmas 2019 . She wanted to show our children what a $hit hole her country was. Now she will travel by herself because now my country is the same $hithole and now I am a prisoner. I had a 37th wedding anniversary to Costa Rica and it went that way. My wife of 37 years and I spent the night on
the floor of the airport terminal. I looked at Puerto Rica and we booked our flight to Costa Rica. My bad. I have since let my USpassport expire rather than take “the mark” in yet another way. The depth and breadth of our freedom is not freedom, it is containment in a cage in which we can see the world we desire to visit but are stopped by bars sometimes too thin to be seen. We have chosen to stay “home” and enjoy the US.

Is there any way to get some accurate statistics as to what percentage of those on the registry are actually a danger to anyone else. That is the kind of statistics we need. But of coarse politicians don’t want that because they know that would pull they rug out from under there popularity scam there putting over on everyone.
Actually, if you look up recidivism rates for sex offenders on google, it shows that the majority of sex offenders are first timers. Of those first time offenders, most dont reoffend and those that do, commit a different crime. There is a small portion that commit another sexual offense. If you compare that to someone who commits murder, the rate is much higher. So the numbers are out there. It just doesn’t fit the narrative of being tough on crime or victim justice or whatever.

But it’s an insult to the intelligence of the public to suggest that these actions will in any way protect anyone from exploitation.
Children in the Philippines and elsewhere will continue to be exploited by foreigners during this travel ban. And it will be a source of national embarassment, shame, and befuddlement— as in “I don’t get it, we already passed laws preventing this, why aren’t they working?”

If someone is on probation, they must ask for permission to leave the county I believe. So leaving the country would probably not be allowed.
