Ok Cherokee I am back for just a little while. Yes advocacy or Storytelling is a good tool and yes we all can advocate and ask for a redress of grievance. Even advocacy committee's strive to petition Governors, state depts. in this ordeal we face. Yes lawyers jump on the bandwagon to help in many of these ordeals. Going to court is not easy for many involved in a lot of this registry issue.

One has the intimidation factor, the abuse factor, and also the deceptive factor or who deceives who today. Yes telling one's story is good, Even keeping notes from day one of one's encounter is good. Of course I can't speak for another but advocacy groups and committee's can help resolve many issues we all face.

Whether one fights with the sword of Justice or in the evil of much of this deception that mankind undergoes on another for vain or blind justice one should take another look at all this miscarriage of justice.

Advocacy is always good if presented in a just and truthful way or why go to court in front of the unjust or did many take a plea deal out of intimidation at the time.

Of course it will be up to the SC legislature to address this, and we know they will tailor the remedy to be as narrow as possible.

‘The lifetime inclusion of individuals who have a low risk of re-offending renders the registry over-inclusive and dilutes its utility by creating an ever-growing list of registrants that is less effective at protecting the public and meeting the needs of law enforcement,’ justices wrote. ‘There is no evidence in the record that current statistics indicate all sex offenders generally pose a high risk of re-offending.’

What I was going to say!

I think we make a similar argument (among others) in our Ex Post Facto Plus challenges (lack of due process being part of the ‘plus’).

I don’t know whether a state Supreme Court ruling is considered persuasive in our Federal circuit, but it’s encouraging to see.

In a unanimous ruling, justices wrote that ‘requirement that sex offenders must register for life without any opportunity for judicial review violates due process because it is arbitrary and cannot be deemed rationally related to the General Assembly’s stated purpose of protecting the public from those with a high risk of re-offending.’

As quoted by one of the news stations.

S Carolina Supreme Ct: mandatory lifetime registration is unconstitutional.

Multiple links. Google it. I’m serious!

Registrants should be able to petition out of the registry if they are low risk, the court says.
