Florida Supreme Court Rules FDLE has No Standing to Set Aside Removal from the Registry
For the second time that the issue has come before the Supreme Court of Florida and for the second time that the decision was unanimous, the Supreme Court put an end to the FDLE’s attempt to reverse a Trial Court’s Order removing a registrant from the Florida Sex Offender Registry.
Florida Statute Section 943.0435(11) provides a mechanism for people on the registry to be removed from their obligation to register if they meet certain criteria.
The petitions are brought in the Criminal Division of the Circuit Court and the decision is made by a Circuit Court Judge. In nearly every case, the Florida Department of Law Enforcement will move to vacate and set aside the Order or will Appeal the order (or in many cases, both).
Attorney Ron Kleiner, who has represented several dozen individuals who have secured removal of the requirement to register, has been dragged to District Courts across Florida multiple times, and to the Supreme Court twice now, and has not lost. Today he got another win, and more importantly, another among our population is free from the irrational and ineffective burdens of registration.
We can’t say why the FDLE is so reluctant to let go of anyone – these people have all lived arrest free for decades – but the FDLE sure puts forth a lot of effort. Hopefully this latest decision will curb some of that.

FDLE is doing what they believe is right by fighting just as the AG would be or the Prosecutor would be in situations like this. They get political credibility for it and already are being paid, so they need to do something with their time.

I’d love to get my face taken off the FloriDUH registry someday. I wonder if I could try in federal court since I would be loathe to have to visit FloriDUH to do all this.
It is a slap in the face that EVERY time someone chooses to attack me, they use the FloriDUH registry pic.
That is the photo taken of me after 3 weeks of incarceration, inluding six days in extradition over the road, for a crime I did not commit. I was denied hygeine, not able to shave, and by the time I hit Broward County, I had severe Edema from the shackles and the high fat/sodium slop we were fed.
Lets not forget that the only reason I’m registered there was because of the false allegations the Books helped facilitate against me.
It isn’t so much that the registry itself bothers me as much as THAT PHOTO is what pisses me off.
Ron Kleiner is not only extremely competent and an expert in Florida law as it relates to registrants, he’s also extremely honest, transparent and accessible. He’s been informally advising me several years about my case and I will be hiring him when my 30 year anniversary comes up next year! We are extremely blessed to have this man in our fight!!! THANK YOU RON!!!!!
I live in California now, but I was very happy to have Ron do my Petition for Removal from Florida’s Registry! Ron kicks ass! He really is the best at this and I cannot recommend him highly enough! Furthermore, as the previous commenter noted, Ron is honest, straightforward and 100% working hard for his clients!
