Ex Post Facto – Sustainer 2023

May 2023 Update on the two Ex Post Facto (EPF) cases filed by FAC: EPF I case won in the 11th Circuit Court of Appeals and was returned to the Southern District Court. The FAC EPF II case got the green light to proceed in the Northern District of FL. The court has set a scheduling order, with a trial date set for July 2023. The goal of the these legal challenges is to have the registry recognized as punitive rather than administrative. The most immediate consequence of this would be that only laws and requirements active at the time of offense could be applied to a person required to register. With your continued support, we can sustain the strength of our argument with expert testimony and the like, as well as cover other costs associated with cases of this magnitude.

Thank you for your contributions to the General Operating and Membership Fund. FAC does not receive grants or funding as a 501c4 organization. Each dollar received is needed to cover the costs of communications, membership meetings, mailings, conference attendance, professional organization fees, supplies, printing, and postage. Our goal is to reach every registered citizen in FL, and have a seat at every possible table to let our voices be heard. This is a non-profit organization; the more we can raise, the more work we can do, and the more places we can be. No one in the organization is paid for their time and service.

However, for tax deductible donations, you can make check payable to “Justice Transitions” and annotate the intent of the donation on the memo line, such as “FAC Legal Fund”. A tax deductible receipt from Justice Transitions will be mailed to you.

NOTE: Florida Action Committee is a 501(c)4 non-profit organization with the ability to do direct advocacy and lobbying (which is not tax deductible). While Justice Transactions is a 501(c)3 non-profit that focuses on community outreach and support (which is tax deductible).

Funded Goals

In-Person Reporting Challenge (FUNDED)

The goal of this legal challenge is to eliminate or significantly reduce the requirement to physically report (in-person) to the Sheriff's office.

Non-Registrant Collateral Consequences Challenge

FUNDED
This lawsuit will challenge the registration requirements imposed on people not on the registry! It will be brought on behalf of registrants' family, friends, employers and others who are impacted by the registry by virtue of living with, employing, or even sharing the same family name as a registrant. Plaintiffs will be spouses who have their vehicles registered and flagged, children who can't have a parent watch them graduate or perform in a school play, roommates who are prevented from decorating their home for the holidays, and others.

Out of State Challenge

The goal of this legal challenge is to remove anyone on the registry who is not currently residing in the Florida community.
