NY: Class Action Lawsuit Filed Against Residency Restrictions
About 100 sex offenders who have completed their sentences are being kept in prison because the 1000 foot residency restrictions leave them without any possible release residence. A class-action lawsuit in NY against the corrections department and the agency that manages city shelters was filed this week, according to a Wall Street Journal article on behalf of registered citizens in the State who are being kept in prison long after their sentences have expired.
The lawsuit claims that the Department of Corrections and Community Supervision is illegally incarcerating those whose sentences are complete, and the city, which is obligated by law to provide shelter, isn’t making shelter beds available.
Many registered citizens would like to return to their families or would have suitable housing, but the sex offender residency restrictions prevent them from moving into their residences. Additionally, the number of potential homeless shelters which are outside the 1000 foot buffers is VERY limited.

Since it’s technically “False Imprisonment”, And the Prison is still getting paid to house these people, Shouldn’t the State be “Required” by LAW to pay these guys for each day there held against their will ???. I mean, If your acquitted of a charge, Your allowed to “SUE” for every day that you were held against your will, So why can’t these guys get “PAID” also ?? I’ve heard of people getting $1000 a day for every day they spent in Jail and then was found NOT Guilty ????? Yes They sid wrong, But YES they’ve paid there debt !!! Out West, There is no “Restrictions” of any kind in almost all the States !! And they don’t have many problems !!! Why can’t people see that the “Registry” and its CRAZY rules are causing all the trouble !! It’s really not the OFFENDER !!! Other than the fact that yes they did comment a time terrible crime, That they have paid “Dearly” for!!!!! Wake Up America !!!!
How horribly inhumane is it of New York to use this method to hold RSOs past their time…maybe someone can be arrested for this crime!!!

This is so sad and wrong. We are treating our citizens worse than illegals coming into this country.
