A National Push For Victims’ Rights is Now Hitting Florida. But Critics Are Fighting Back.

A proposed amendment to the state constitution known as Marsy’s Law for Florida would enshrine specific rights for crime victims, such as the right to privacy and the “right to be reasonably protected from the accused.” It would also give victims legal standing to testify during hearings to determine a defendant’s bail, sentencing, plea deals and parole.

“The pain a victim suffers in the aftermath of a crime is hard enough without being revictimized by the criminal justice system,” said Senator Lauren Book of Broward County, herself a victim of sexual abuse as a child and now an advocate for Marsy’s Law for Florida. “Marsy’s Law will give each victim the promise of having their voice heard.”

Critics say these changes and others would tip the scales of justice too far in favor of victims.

    This has been going on for years in some form in Florida . In 2005 I was charged with l&l conduct in fl. They were not going to make the so called VICTIM testify. The prosecutor said that they had “circumstantial evidence ” which was the 15 year old female saying I done it. So this is nothin new. Just a way to make it actually legal now.

    Everyone is a damn victim in our society. No one has balls any more in our culture to stand up to crap like this. Sh*t happens in life. Deal with it. I realize there are legitimate and horrible things that happen to people. But you know what, I was molested too by an older boy when I was 5 years old. And that led me to a life of mental torture and was a big contributor to my sexual addiction that unfortunately led to me being caught up in those stupid stings and having to deal with this crappy life of being an RSO. I’m so sick and tired of Lauren and Ron Crook I could scream. You can’t tell me that there is NOBODY out there who can bring an end to these idiots. Someone out there has got to have dirt on these scumbags.

    And the other side of this argument is, in a lot of cases the so-called “victim” has lied about their abuse because a jealous mom or ex-girlfriend put their daughter/son up to telling the authorities that “he touched me” to get back at them. I’ve seen it far too many times. A guy I was in prison with had a life sentence because his ex-wife got their 5-year old daughter at the time to lie about being molested by him. When she was 21, she recused her story to the authorities, his sentence was OVERTURNED, and he was released from prison after serving 20 years in that sh**hole. But, this stupid law would further empower the “victim” in this situation, especially if the Defense attorneys can’t have access to them. It’s not a fun process for the TRUE victims in cases, I understand, but it’s how the justice system works. If you don’t like it, don’t live here I guess.

    The article states that this is being implemented across the Nation – already in places where it has been applied it is causing more harm than good and not accomplishing what is was intended to accomplish. This not good folks and worse this is one of those Bills that voters will not truly understand and they will vote on what they think it is about and not what it really is – they will see it is for victims rights and they will all vote yes. This is bad….

    When does it ever STOP? This Book person is 1000% out to make everyone life miserable and out of control. I’m sorry that you were abused, however your abuser is in prison. You should look to your parents for leaving you with such a person.

    My husband can’t have his probation motified without the prosecution saying they need to contact the victim and then returning with the victim’s mother’s opinion. Not the adult victim.

    We might know that Senator Book is involved. No one should be in office who is there for the purpose of pushing a personal agenda. Our representatives should be in office to represent all citizens and be willing to listen to all sides of a controversy.
