Are you listed on a commercial “mugshot” site? If so – there is a way to get off in Florida.

The parent company of Mugshots.com, a website that pulls arrest photos from local police departments, publishes them on the internet and then attempts to charge a fee to have the images removed, was sued in a Broward County court, after extorting the man for money in order to remove the image.

This is just one of a long line of cases in which the company has been sued. More bad news for the owners; they’ve been charged with extortion in California and two are already in custody.

In the past few years, a new business has emerged; online companies who post embarrassing information, such as arrests, and then charges victims a fee to remove them.

In 2018, the Florida legislature enacted a new law that says:

   34         (2) A person whose arrest booking photograph is published
   35  or otherwise disseminated, or his or her legal representative,
   36  may make a request, in writing, for the removal of an arrest
   37  booking photograph to the registered agent of the person or
   38  entity who published or otherwise disseminated the photograph.
   39  The written request for removal of the arrest booking photograph
   40  must be sent by registered mail and include sufficient proof of
   41  identification of the person whose arrest booking photograph was
   42  published or otherwise disseminated and specific information
   43  identifying the arrest booking photograph that the written
   44  request is seeking to remove. Within 10 days of receipt of the
   45  written request for removal of the arrest booking photograph,
   46  the person or entity who published or otherwise disseminated the
   47  photograph shall remove the arrest booking photograph without
   48  charge.

This law goes into effect.on July 1, 2018.

That means, beginning this July – you can write to the website owner and demand that your information be removed from their site.

We are still determining whether the law will impact sites such as http://www.bustedoffenders.com/, https://www.homefacts.com/offenders.html, whose business model is not to charge for removal, but to charge for a background check service or notifications.

      That’s a separate issue that can be challenged.
      The state currently does not charge any fee.
      Some Counties do, but not the state.

    Does this law apply to the mugshot newspapers the gas stations sell in Polk County? They have a section in each issue besides showing all the other arrests just for sex offenders that is either done by zip code or done random.. Does this apply to that? Does any other county have this same type of publication at their gas stations?

        My follow up question is the statute states: “Registered agent of the person or entity..” Just wondering how that equates to only commercial websites? Is there a header in the statute definining the terms of the statue that you have not listed? Just wondering..

            So since the court charges “court costs” to get in front of a judge and hear the motion for removal from the registry, would that then be considered a “fee” for removal as you have stated?? Still, just wondering..

            If I need to send a physical letter to remove my mugshot from arrests.org which addresses do I send it to? You replied to other websites addresses above, but not this one.

          Mugshots.com removed my information – However – Rapsheets .org has not and has threatened me as well as asked for money to remove the info – What can I do to remove it

            Unfortunately, hire an attorney to send a letter or sue them to have it removed.
            If you have a copy of their request for payment to have it removed (in writing) send it to your local state attorney. They can’t do that.

            Nobody replied to me on physical address on arrests.org? Are you ignoring the citizens?
            What kind organization is it?
            I’ll find/email to a person un change to report the issue and Governor as well. There is no assistance from you whatsoever. Extremely disappointed.

              We have no affiliation with arrests.org. We don’t know where their physical address is. We are not ignoring our citizens – if you post something on this site and nobody has the answer, you will likely not get an answer. Since you are concerned that we’re ignoring you, I’m replying to let you know we don’t know.
              I’m sorry you are disappointed. Looking up addresses for people does not fall into one of our core functions.

              I am just a member of FAC. I donate when I can. This place is made up ENTIRELY of volunteers who take time out of their own day to do this.
              There are also over 2,000 members here, and if I were to guess, about 2-300 people have questions/posts DAILY.
              The volunteers, some who work 8-10 hours a day to support their own family system, log on after supper/dinner and toil into the night; answering questions, filing litigation, approving comments, holding meetings, researching law, case law and federal law.
              In case you havent noticed there are 3-4 lawsuits going on in the State of Florida; with one being kicked up to the Federal level (I believe)
              PLEASE DO NOT take this as attacking you, demeaning you….
              But for you to come on here and drop 1-2 posts Demanding a website address, then stating that FAC does nothing to help sex offenders, their families, or the community to me puts you in the light of entitled and childish.
              You want FAC to drop everything so they can get you a site that YOU could get if you did some research.
              I WAS like you, Very assertive, to the point of being demanding, insolent and just plain stupid with my requests.
              ALL of the “higher-ups at FAC” were super frustrated with me and my demeanor.
              I took a week off and went back and reread most, if not all of the posts that have been posted.
              FAC is here to help us — the sex offender community, their friends, families with providing updates on all litigation, information and news worthy items in a timely and orderly fashion.
              KEEP IN MIND THEY ARE ALL VOLUNTEERS!!!
              FAC cant drop everything to help just you. So, if you dont get a response within a week or two, then write back, nicely and ask. Dont come on here and say they dont respond.
              I, myself havent heard anything about the NEXTDOOR lawsuit thingy in a few weeks— but have you heard me on here screaming? They will post when they get time.
              Also remember, it takes them just as much time to find this info as it would take you to do the same.
              FAC is a wealth of info, but is not your personal 411 directory.

I do not want money I just want the public to be aware of the schemes of Kyle David Grant and to never give money to any mugshot removal company because they have ties with the mugshot publishers.
