Are you listed on a commercial “mugshot” site? If so – there is a way to get off in Florida.

The parent company of Mugshots.com, a website that pulls arrest photos from local police departments, publishes them on the internet and then attempts to charge a fee to have the images removed, was sued in a Broward County court, after extorting the man for money in order to remove the image.

This is just one of a long line of cases in which the company has been sued. More bad news for the owners; they’ve been charged with extortion in California and two are already in custody.

In the past few years, a new business has emerged; online companies who post embarrassing information, such as arrests, and then charges victims a fee to remove them.

In 2018, the Florida legislature enacted a new law that says:

   34         (2) A person whose arrest booking photograph is published
   35  or otherwise disseminated, or his or her legal representative,
   36  may make a request, in writing, for the removal of an arrest
   37  booking photograph to the registered agent of the person or
   38  entity who published or otherwise disseminated the photograph.
   39  The written request for removal of the arrest booking photograph
   40  must be sent by registered mail and include sufficient proof of
   41  identification of the person whose arrest booking photograph was
   42  published or otherwise disseminated and specific information
   43  identifying the arrest booking photograph that the written
   44  request is seeking to remove. Within 10 days of receipt of the
   45  written request for removal of the arrest booking photograph,
   46  the person or entity who published or otherwise disseminated the
   47  photograph shall remove the arrest booking photograph without
   48  charge.

This law goes into effect.on July 1, 2018.

That means, beginning this July – you can write to the website owner and demand that your information be removed from their site.

We are still determining whether the law will impact sites such as http://www.bustedoffenders.com/, https://www.homefacts.com/offenders.html, whose business model is not to charge for removal, but to charge for a background check service or notifications.

      (3) Any State or local agency identified by the Expunction petition as bearing record of the offense that has been expunged;
      (4) The Department of Public Safety, Combined Records Section; and
      (5) The State Bureau of Investigation.

      We are none of the aforementioned; we are a privately held media company.

        publicpolicerecord.com. I have requested many times – giving them my actual drivers license, passport and dismissal papers. I live in the state of Florida and the information is still there. They only updated the site with my name with big yellow and black letters “Dismissed”. My photo is still there as is the arrest record. I’m so upset – it’s just not right.

          They require an expungement for complete removal. There is a bill in the Florida legislature called SB 444 It will make your booking photograph private. I recommend calling your Florida res and senators. It is awful that your photograph is published but if SB 444 becomes law you may have it removed. Best wishes.

          I feel for you. My family members mug shot is on this site and he was cleared. He also has children and other family members who are greatly affected. Turns out that those who publish these along with names and personal informaton is also placing family members including their children in harms way. These companies don’t care, so they really are not all that moral and they are of a dark spirit. What’s scary about these types, they are intentional and deliberate. They are not of Christ…don’t think for a second they are doing all this for social justice, etc. These are bad people, they just haven’t been caught…yet. Not in a way that’s coming to them…it’s coming…may take awhile, but I have no doubt that it’s coming.

            Someone posted about actual background checks being more legit. The problem is defamation of character from false Google searches. Maybe sue Google for not fact checking their websites they put in their search engine. Go bold or go away with whining and not doing anything about it. I see so many people having same problems but nobody doing anything about it.

        That amount is for a few reasons:
        1. The persona “Cary McCormick” is no longer as useful as it previously as because it has been exposed as a persona copy cats are using.
        2. The site owners are starting to be more hard pressed to keep the sites as profitable because the lid has been blow off the “business” in at least 18 states and counting where there is legislation against these sites.
        3. One state has changed the code on police sites so that drop catch code cannot be used to create the sample php pages.

        That is just sickening on so many levels. First that you have to pay at all to have them removed. Secondly as soon as you have them removed another newly named website pops up with your photos.
        Thirdly they are making money off of your misfortunes. And finally, most of these places are scamming you and won’t remove squat. If the authorities shut them down, 20 more pop up with different names and aliases for the owners.

        When you are on the registry, at least someone has to make an effort to search for you on there. On these mugshot sites, I see them pop up all the time on sites where I am watching videos, or playing video games, and have even seen them on news sites on their advertisment sections (Where they make money to run an ad on their site).

    1. contact your local state attorney general consumer office file a complaint
    2. contact Federal Trade Commission 877-382-4357 file complaint
    3. contact Internet Crimes Complaint Center FBI http://www.IC3.gov
    4. If in violation of state statue where as a crime has been committed contact your local law enforcement and file a report.

    The only way we can get these guys to stop is by everyone calling or writing. The more people, the more likely they will peruse to investigate the crime. I was advised it has to be a large amount of people calling or writing.

        The request must include sufficient proof of identification. That’s what the statute says, and they cite it.

        So just send them a redacted copy of driver’s license. You don’t have to tell them the driver’s license number. What more data can they collect from it?

        Be careful of that Cary McCormick guy at tricountybusts or tricountybusts.com. Cary will take down the mugshot but replace it with a graphic that is more humiliating than the mugshot and doesn’t give a damn if the case never went anywhere. He charges a fee for removing the arrest from the site. Mofo is shady AF. Beware.

                GREAT bill deserving our support. Grady Judd will HATE it.

                True, it does not remove registration photos. But it removes the ability of sheriffs to plaster peoples’ booking photos in acts of security theater, such as online stings and compliance operations. And it’s consistent with the notion of innocent til proven guilty.

                I will defer to our Legislative Committee to analyze this bill and make recommendations. But on the surface, it deserves our support.

      Thank you for the best answer. If you could, please review the list of sites, who will not remove people with expunged records, who does not want to reply. The sites like arrests.org will remove you quickly, but the other like crimeinformer.com and mecklenburgcountyrecords.com does not cooperate. They are working with middle agents who charge you for removal. Police should not be defunded, but corruption inside the police must be removed.

    I was just recently solicited for money to remove my mug shot. My case is dissolved. Isn’t this against state statue 901.43? The website is TriCountyBusts owned by Cary McCormick. I checked SunBiz.org but found no trace of legal business entity. This is extortion and violation of consumer right laws.

    If you have a past criminal conviction, or a charge that has been dismissed, you may want to figure out whether you can “expunge” your criminal record. Through the expungement process, SWIFTHACKGENIUS @gMail.com specific convictions and dismissed charges to be wiped from your record after a certain amount of time has passed. There are a couple of different sealing or expungement laws, and the requirements are a bit different for each. You can contact him and he will assist You.
