MI: A huge win in Michigan
Judge Mark A. Goldsmith of the U.S. District Court for the Eastern District of Michigan ruled on a class action brought by the ACLU of Michigan that the state canβt enforce the entirety of its 2021 version of the law against offenders who committed their crimes before July 1, 2011. He gave the legislature 90 days to rewrite its laws.
Among the many just findings in this decision, the Court found that the registry is punishment!

Sir I’m an ex-victim of child molestation 3 times by 3 different people around the age of 6 7 8. I’m a staunch supporter the harshest penalties for these heinous crimes. So just know that if you did the crime, you do the time and all that it incorporates. Q: What was your charge, and did you do that nasty deed? I can loo you up if you refuse to tell me why, as I have Polce officer friends and family who can get me your records. Were you molested and then repeated what was done to you by others? Understand Overstand and Innerstand that speak publicly about these types of crimes against children and the lifelong affects it has on the victim for life and not just in the moment.

Whats the age difference sir and in what state? Understand each state operates under its own laws under the Corporation of America oe the federal government. Also each county has its own rules and regulations as well. Good luck

My conviction in Michigan was in 1993, before a registry existed. It was a case of me meeting a girl who in no way looked or acted like she was 15. I was 25 at the time and her parents even condoned the relationship. It wasn’t until weeks later that her father told me she was 15. Her mother, who was divorced from her father, made advances to me, which I turned down. Long story short, she filed a police report against me for being with her daughter, which she later tried to have cancelled.
I took a no contest plea agreement.
It wasn’t until 1996 that the Michigan registry was created and I was placed on it. Then on July 1 2011, my 25 years was extended to life. It has done nothing but harm me in ways you can never understand. Being called a rapist and a child molester when that is not the case. Being turned down for employment. Having to take time off work every 3 months to verify at the police station. Meeting a nice girl I’d like to date but don’t because of not knowing how she would react to me being on the registry. I have had my house and cars vandalized by people I don’t even know who I have never harmed simply because I’m on the registry. I have had neighbors who treated my like the greatest neighbor in the world until they find my name on the registry and then I’m suddenly the worst person in the world. I could go on and on.
The Michigan State Police website, which controls the registry, states its purpose is to protect the public against future sex crimes by registrants, but I ask you how is that possible? A person hell bent on committing a crime does not care about laws or the registry. If I wanted to commit a sex crime, which I don’t, no registry is going to stop me.
The age of consent in Michigan is 16 and it turns out her 16th birthday was 3 months after I met her. I honestly did not know until later because like I said, she did not look or act her age and her parents did not tell me at that time. so I ask you, does that make me a monster? Is that reasonable to make me register for the rest of my life? Like I said, the age of consent here is 16, but other states set it at 18, so what about people in those states who have sex with a 17 year old? Why is it legal in one state but not the other?
I do not condone rape, child molestation or CP and those crimes certainly deserve harsh punishments, but is it fair to me to be forced to register as some dangerous person? If I am so dangerous, then why am I not in prison?
I can never imagine the harm and pain you went through, but I can certainly understand your anger and frustration. I truly am sorry for what happened to you. but it was not me who did it to you.
You stated, “if you did the crime, you do the time and all that it incorporates” and I agree with that, but when I took my plea deal, there was no registry, so why should I be subject to that? What was done to me would be no different than changing the laws for a speeding ticket to not just a fine, but 30 days in jail as well and making everyone who had ever received a speeding ticket in the past now serve 30 days in jail. It would be no different that taking something that was not a crime 30 years ago and now making it a felony for doing it and charging everyone who had ever done it.
I did my time. I paid the price in full and then some so why should I be subjected to more and more punishment?
Making me report to the police station every 3 months for the rest of my life makes me feel like I’m still on parole. Every time I walk in there I have fear of being arrested for some unknown rule violation I knew nothing about. I just want to be free of it all and to live my life quietly without fear of going back to prison for some technical rule violation that I did not understand.
I feel you. When I was charged and told I would have to register. I never knew or herd of sex offender registry. I think the system is messed up. We should have to suffer for life. One time defender.
Solution: find a state that you can move to with minimal requirements. Good luck.
It sounds wonderful as written. But so did Does v Snyder. I hope Michigan doesn’t get away with simply enacting a new registry law that is as unconstitutionally retroactive as the 2021 law. I am tired of reporting to the police 4 times a year. But the stigma on my family hurts even worse.
What was your crime if you don’t mind sharing and what part convicted you? Was it a trial jury?
So it has taken this long for a district court in the sixth circuit to actually enforced what the appellate court said a number of years ago about these ex post facto restrictions? Interesting the one part that may cause some trouble for some states if the sixth refuses to overturn this decision is the bit about differential treatment for out of state registrants. Thatβs what kept me from moving back to Kentucky with the rest of my family. As best as I can tell, my registration requirement mightβve automatically terminated initially in 2010 or 2016 and even with a change in law later extending the registration period, 2020 or 2016. But because I was in Florida, I wouldβve been automatically made a lifetime registry. So I moved to Georgia and now am in the middle of an appeal because the judge denied my removal based on a law that didnβt go into effect until after I filed my petition.
How can we remove ourselves off the registry if we live in Florida. Even though our instance situation happened in another state?
Florida doesn’t even take you off when your dead. They Cha Ching your soul indefinitely!
