Sex offender gets jail for not reporting social media password
A Level 1 sex offender from the Tuscarora Indian Reservation was sentenced Thursday to a year in the Niagara County Jail for not telling authorities one of his social media passwords.
______________, 48, of Susie’s Lane, must register because of a misdemeanor sex conviction in 2004, defense attorney David J. Mansour said.
In April, _________ pleaded guilty to a felony count of failure to register. He reported two social media accounts last year, but only one password. Mansour said _________thought the accounts were linked.
County Judge Sara Sheldon could have sent ________to state prison for up to four years, which the prosecution recommended. Mansour argued that would be unjust, because _________’s original offense was a misdemeanor and he has not committed further sex crimes.

Our Internet Identifier lawsuit was filed and litigated – we are awaiting the Court’s decision.

Since when are we required to give PASSWORDS of our Online Accounts ??. Boy, For something that is NOT Supposed to be “Punishment”, There sure are ALOT of people being “Punished” for failing to “Comply” to the DOZENS OF CONDITIONS that are not considered “Punishment” !!!!!!!!.

It’s the Lunsford Act. Monica Lewinsky was 22 (nothing illegal there). In order to strike a law you need legal grounds. The lawmaker’s own behavior is not a legal ground.
You are, however, right about Mark Lunsford’s child porn stash and Foley sexting interns. With the statutes of limitation being eliminated, they should be prosecuted.

Of course the hypocrisy is ever present for us. Law makers throughout history have always passed laws against the very things (usually sexual and financial) that they claim to be fighting against only to be often busted for doing that very thing!

J.G.in AZ, please tell us POOR folks in Floriduh what to do about our situation. All of your suggestions have been tried here and failed. We have no victories, we litigate to try and rollback what has already happened. That takes years for anything, if anything, to happen. At least in AZ you could get rid of Arpaio. We have 67 Arpaios here. We have a legislature controlled by lobbyist Ron Book with a daughter authoring and submitting new onerous bills every year. There is no hope in Floriduh.
@JZ I have several answers however F.A.C censor some of my creative advice. First of all, We need to put some ones family member in office that a sex offender is related to and give them support to help us, There should be a number of terms for a lobbyist, Ron book is what in his early sixty, the stress he is under his health will fail soon. The Sorna Act July 27, 2006 It violates the due process clause The law was made in emotional state of mind therefore reason failed, It gives the so called victims a peace of mind and false hope that a person is finished with prison sentence that some sort of supervision is required to watch and track people with certain offenses. In other words since a so called victims live life sentences those convicted of sex crimes should live life sentence as well. This violates the double jeopardy clause and plea deals give to offenders You given a Judicial sentence and if you are release you do another 10, 15, 25 and 25 year sentence imposed by legislature hence supervision by criminal authority…. If it really civil they where is the Legislature police force? sheriff Aripio was kick out of office too many lawsuits against him and his racial profiling. You know what there was over 100 people downtown phoenix with signs and supporters and the public voted his butt out of office. I think Costa Rica is on the travel list where offenders are not welcome, but I get your point.
Costa Rica won’t let you in. They ban all felons as well as registrants. Think Belize in that part of the world, and you’d be surprised. I hear 200k can last you 20 years there.
It’s on my list of options to get out of this poisoned nation.
Besides the absurd situation of being convicted of a felony for something related to a misdemeanor act, there was no victim involved in the new conviction, he DID report his social media account. They could have simply called him and asked if he had mistakenly given them the wrong password, which is obviously what happened. The prosecutor requesting a 4-year sentence is just ridiculous. Very likely, the prosecutor has a vendetta against this man because he/she thinks the original misdemeanor conviction wasn’t enough. Personally, I don’t remember all of the passwords I use. My browser remembers most of them for me.
Yeah it certainly looks like a 4th and 8th amendment problem to me. 8th especially that the consequence for failing to register is so much more significant than the offense he was convicted of.
I know I’ve said this more than a few times, does FAC know of a failed 8th amendment challenge to SORNA somewhere, or is there some sort of feedback from an attorney that says administrative felonies are usually upheld?
