UT: Woman challenges lewdness statute. Says it discriminates against women.

A Utah woman stripped out of her clothing after she and her husband finished installing itchy insulation. As both she and her husband stood topless inside her home, her stepchildren came down the stairs and saw their mom.

When law enforcement caught wind, they filed criminal charges against her; three counts of lewdness involving a child. She faces jail and 10 years on the registry. She has been fighting the charges for months.

Her attorney is asking a judge to find that Utah’s lewdness law is unconstitutional because it discriminates against women. Her husband also had his shirt off and wasn’t charged.

Dear R M, I agree. There’s a lot missing here. But keep fighting nonetheless!

My guess, and it’s that, simply a guess, is that one of the kids innocently said something to a friend or their mother. Another non-related parent called the police out of self-righteousness or the mother called them.

An angry ex-wife (mother of the stepchildren) most likely. I have one that has made half veiled efforts to look for ways to have me violated while I was on probation, so I know the type.

Considering it just became legal for women in Utah to go topless, does this case not become a moot point? If a woman can walk down the street topless, can she also do the same in her home?
This is another example of law enforcement being ridiculous!

Look on the bright side. Once they have placed all Americans on the Sex Offender Registry, which is their ultimate goal, we will no longer be a caste society! Although it will pretty much defeat the election process. 🙂

The law was struck down. She should be able to win this if her attorney knows how to argue it.
