UT: Woman challenges lewdness statute. Says it discriminates against women.

A Utah woman stripped out of her clothing after she and her husband finished installing itchy insulation. As both she and her husband stood topless inside her home, her stepchildren came down the stairs and saw their mom.

When law enforcement caught wind, they filed criminal charges against her; three counts of lewdness involving a child. She faces jail and 10 years on the registry. She has been fighting the charges for months.

Her attorney is asking a judge to find that Utah’s lewdness law is unconstitutional because it discriminates against women. Her husband also had his shirt off and wasn’t charged.

    Just the term “lewdness” has been challenged in Missouri and found to be not enforceable for the simple reason it’s too vague a term. Laws have to be explicit. What is lewd to one person is not to another. Any laws using that term are unconstitutional,but you need a good lawyer because law enforcement doesn’t care how unconstitutional there laws are. Watch out guys won’t be long we’ll be wearing bras at the beach.

    This whole story is bizarre!

    Since when do children within the family unit not see occasional nakedness? That’s simply a part of belonging to a family and living in a household. It happens. And it is quite normal. (I am assuming she didn’t start fondling herself and making lewd noises!!!)

    Our society is seriously twisted if this is the new standard!

    I can’t remember the exact incidents but this has been challenged several times in courts already and they always win the challenge. Its just a way of harassing and trying to bully someone.

    They need to determine if she breast fed these children previously as babies, or changed their diapers, and also file charges if it is determined that she did

      I agree this is over the top, no she did not breast feed, they were her step children

        Do you really think that it matters that they are her step-children or whether she breast fed them or not? These laws are insane! Everyone is grouped together, we are punished for the actions of others and the laws are similar to Nazism!!! Society had no problem with the Fed or states imposing these insane laws on offenders. Glad to see it effecting the average voters. I hope it gets worse, to the point that society as a whole stands up to this tyranny!

          No I do not think it makes any difference, especially since it was in the privacy of her own home.
