This coming October a new bill will become law. The bill was an “anti human trafficking” bill, which is good, but the way it goes about reducing human trafficking is by increasing the penalties for prostitution.

A first-time “John” will now get a first degree misdemeanor instead of the prior second degree. Spend a minimum of 10 days in jail, 100 hours of community service and attend (and pay for) a class (much like traffic school only human trafficking school.

The bill also allows a victim to petition the court to expunge their criminal history relating to human trafficking.

Wait a minute… that was the confusing part… the victim… OH! do they mean the Prostitute? is that what Representative Ross Spano, the House sponsor meant when he said, “The passage of this bill reflects a commitment by the Governor and legislature to protect those who are victimized by such heartless crimes. By offering victims of human trafficking the opportunity to expunge their criminal records, they will be afforded the opportunity to recover and succeed.”

So, if I’m understanding this correctly… guy gets caught with prostitute. Guy goes to Jail, hooker gets her record expunged. While guy sits in jail for 10 days, hooker cleans her slate and can continue hooking without the concern of an embarrassing arrest record. That encourages more prostitutes, which, in turn, brings more men into the system and keeps the animal fed!

Now before anyone goes making comments, true human trafficking is a horrible crime that should be punished to the greatest degree. Anyone who forces another into prostitution deserves the harshest of penalties.

But… you know who will get caught up in this law? Poor schmucks who solicit a willing hooker (or undercover cop, more likely). You know who won’t get caught up in this? Actual human traffickers (and former governor of NY, Elliott Spitzer, of course). The people who are actually trafficking humans would get more than 10 days in jail and hooker school anyhow, so why bother? I mean, really?

Again, we are 1000% against human trafficking but this law is another “feel good” measure that will allow politicians to pretend they are doing something to crack down on a heinous crime by ensnaring the wrong people
