A New York City man dodged the threat of a 20-year kiddie-porn prison sentence — all thanks to the kindness of a porn star.
XXXXXX, a pizza-delivery guy from Brooklyn, was put on trial in Puerto Rico for allegedly transporting child pornography after US Customs agents found a dirty DVD called “Little Lupe the Innocent” in his bags as he passed through San Juan Airport security on his way back to the city. The agents said the actress in the video, porn star Lupe Fuentes, was underage, and they cuffed him.
But Simon-Timmerman was sprung earlier this month after Fuentes flew to Puerto Rico and proved in court that she was 19 at the time the film was made.

When I was arrested, they seized my computer and found five deleted pictures that they claimed were under age girls. FDLE said that they had a Doctor who could say with a high degree of certainty that these young females were under the age of 18. Several people including my lawyer commented regarding how the hell you get do you get a job like that? Those particular charges were never brought by the state attorney. This Little Lupe person was apparently known in porn circles I guess. I doubt that this was the first time that the United States government had seen this material. I am wondering how the United States Attorney was able. to proceed with this charge all the way through the trial phase?
Wayyyyy back in the early 1990s, I was on probation. I got a knock on my door and my probation officer and 3 Seminole County Deputies rushed me, put me in hand cuffs and dragged made me to take them to my computer.
My Probation officer put some sort of futuristic looking device on my computer that scanned my entire computer in like 3 minutes and ONE image came up that was dated as being received the night before and otherwise nothing was found.
MY probation officer asked the officers to go outside and wait and she said to me, I think you were set up as we got an anonymous call yesterday that you had porn on your computer then I find JUST one image dated the day they called in ?
She said she is not buying it and let me go. WOW
Funny thing is, image was from some porn site and someone had cropped it down and wasn’t even a minor but appeared to be maybe 18 to 20 years old.
Believe it or not, we were also just 5 days from going to court to get relief from probation. My Lawyer asked the probation officer not to bring that incident up but if she chose to do so, he would use that to further prove how corrupt the system is. She did not bring it up and I was released from all paperwork over the screaming and ranting objections of the State prosecutor.
The judge said ” unless you have overwhelming evidence of something that would otherwise cause me to reconsider, the ruling stands”. She tried to rehash my charges from years before but was shut down and this was not NEW information.

Show me the money… I just hope this guy got paid… It would make me feel better after reading it would make me feel better after reading all that bullshit he had to go through it.
Wouldn’t life be better if instead of blanket age laws there was actually a test that showed that you were mentally capable to be an adult?
In the US the majority of people are in fact shelter because of overprotection and first world problems are the norm.
In other parts of the world you grow up in war-torn life and basically fend for your life everyday.
Laws should be made sensibly and with perspective in mind instead of trying to appease the masses.

There are laws were for example, a 16 year old can divorce their parents and become their own caretaker. However, even if they win this, they still have to abide by the laws and cannot drink, have sex with someone over 18, sign a contract etc.
In Canada the legal age of consent is 16. Only reason I know this is, when my daughter traveled there she told me that. I was asked her, ” Is there something you want to tell me ?”
16 is the legal age in 27 states. What’s crazy about the age of consent laws is that even tho a 16 yr old can consent to sex all day with someone older (or even the same age) is that the moment a photo or video of the teenager is taken in a provocative way, it’s considered child porn. Kinda makes no sense. You can see each other naked and all but no photos or video.
And most teens (including when I was a teen with my older teenage GF at the time) like to be experimental and take pics and videos. I was 16, my GF was almost 19 and we recorded ourselves with the old VHS camcorder back in the early 90’s.
That tape is long gone but we had no idea that it was illegal to do that. We were the ones thinking of ourselves as “kids”.
These laws were made to keep crime happening and keep cops and courts in business. It IS a business.
Lastly, when I was in prison back in 2006, I saw a local news station say that Canada raised their age of consent from 14 to 15. And I believe it’s still 15.
So, had i lived in Canada and met the girl I got in trouble for here, I would not have gotten in trouble. What makes a Canadian tee are any different from an American teenager? Nothing.

Funny thing about these “underage looking” porn actresses is that those types of porn are and always have been VERY popular. Many years before my offense, I worked in a porn shop as an off-the-books side job. We had a series of videos called “Barely Legal” which were girls who just turned 18 but still had that youthful appearance (kinda goes to show that age doesn’t have a particular look). Major company, all legit actresses and they were the ones rented out the most.
So what’s funny about it to me is that I believe that most of the men who leave comments about how we should never get out of prison or have a bullet put in us and “if that was my daughter he touched, I’d have….” are the same men who would be first in line to rent and watch the “Barely Legal” series.

I see on the news all the time about law enforcement officers getting caught secretly seeing some girl who is 16. Do not remember the state but a few years ago when they did one of those undercover stings, they arrested a retired judge and a retired former sheriff for going to meet an under age girl.
When I was in law enforcement I would see school resource officers flirt with the high school girls all the time. Wonder how many of them would or did act on those flirts. Maybe that is why they chose to work at the school instead of on patrol.
So in other words, the person was arrested without the information being verified? Shocking. Police would never do that. Evidence is never planted. Lies are never told.
If my short lived career in law enforcement taught me anything, some ( And I stress some not all ) cops are worse than some of the people they arrest.
Although I saw this first daily when I worked at a large police department, I experienced it first hand when I was arrested. The officers who arrested me I do not even remember. They were professional and unmemorable. The interrogation without a lawyer ( Even though I repeatedly asked for one ) was a nightmare.
What is even worse, as someone on the registry ( all who are included as well ) you are guilty until proven further guilty as far as the law is concerned. Generally even if you can prove to the arresting officer than you did register ( I save all my paperwork from registrations ) they will just tell you ” Nothing I can do, warrant was issued, take it up with the judge ” . When you see a judge, they will “Maybe” release you on bond which will cost you an arm and a leg for something you didn’t even do wrong. Then the cost of a lawyer etc. By time you prove it was all BS and you are cleared, you are $15,000 in the hole.
That story happened 9 years ago when the laws were and sentencing guidelines were becoming more draconian. Those changes emboldened ICE and the US Attorney’s Offices to create “fake news” with bogus cases. I fell prey to a similar scheme. Fortunately for that defendant, he was able to prove his innocence. Unfortunately for me, I’m still litigating my innocence after a lengthy prison sentence and lifetime supervised release even though the feds never proved anyone in the images were real minors!
Sometimes there is more honesty in the heart of a ‘bad person’ than in the heart of a ‘do-gooder’ politician.
