American Sentenced In Canada For Possession Of Child Pornography . . . Of Cartoon Characters

There is an interesting criminal case in Canada where American Peter Hasler, 25, of Murrells Inlet, S.C., is under arrest for possession of child pornography. However, the images were not of human beings but cartoon characters. Canada treats sexual cartoon images as pornography – a view widely rejected in the United States as inimical to free speech protections.

Yeppers, it does…see chapter 847 of the Florida statutes. The definition of “sexually oriented material” would include cartoons. The definition of “child pornography” is vague enough to allow for the prosecution of possession of cartoons: “any image depicting a minor engaged in sexual conduct.”

Not sure if they’ve used that to prosecute a possessor of cartoons, but a few years ago, they arrested someone who had been photoshopping the faces of minors onto adult nudes and charged him. Considering that case, I don’t doubt that they would consider pursuing a cartoon-porn case.

Sorry, I always do this…go back and read more carefully after I comment lmao.

They actually do mentions comic books by name. Here is the list of materials that qualify:

any obscene book, magazine, periodical, pamphlet, newspaper, comic book, story paper, written or printed story or article, writing, paper, card, picture, drawing, photograph, motion picture film, figure, image, phonograph record, or wire or tape or other recording, or any written, printed, or recorded matter of any such character which may or may not require mechanical or other means to be transmuted into auditory, visual, or sensory representations of such character, or any article or instrument for obscene use, or purporting to be for obscene use or purpose

If a minor is depicted, it qualifies as a 3rd degree felony (aka poss.of child pornography)

I think that makes all the readers of George R.R. Martin’s series felons in the state of Florida, actually.

Drawings too… better make sure you put clothing on the stick-figures you create because the state’s forensic expert will testify that the image drawn while you were playing hangman was under 18.

I was under the impression that FL had the “cartoon” clause in it’s statures? Is this not correct?
