Bills increase penalties for sexual offenses in Florida

A sweeping bill approved Monday, by the Senate and approved by the House last week would dramatically increase penalties for child sex crimes and AI-generated material and add or increase mandatory sentences.

HB 1159, sponsored by Rep. Berny Jacques, R-District 59, increases penalties for adults using children in a sexual performance from a second-degree felony to a first-degree felony with a mandatory minimum sentence of 15 years. If the child was under 12 at the time, it becomes a life felony offense with a minimum of 25 years.

Knowingly creating or distributing child sexual abuse material would become a second-degree felony, as would engaging in sexual contact with an animal. Ownership of a “child-like sex doll” would become a third-degree felony rather than the first-degree misdemeanor it is now.

    Sorry but increasing penalties isn’t “tough on crime” it’s lazy on crime. It’s so easy to increase a penalty and then say you are doing what you can to decrease sex crimes. But the real work that most legislators are to lazy to do is create education programs, take resources spent on the registry and provide free life long therapy for victims and those who have harmed , and create post conviction scenarios that discourage recidivism like opportunities to find housing, work, and further education. This would take time but have a huge impact on prevention and lowering already low recidivism.

    So since the Ellingberg decision, Where does that leave a PFR from a 1991 sex offence. (That signed a plea deal) with the ex facto decision. Since a sex crime is falling under civil. I am trying to understand. Is anyone taking this go court? Is FAC doing anything? Opinions on hiring a attorney? Any hope?

    And if the 18 yr old is a HS student at the time of the offense, what happens then? If it is of another student?

    Maybe they should move all 18 yr old students to their own school so they are all adults and leave the minors to their own school?

    leave Florida ASAP if you are on the registry. you will get temporary relief in many other states until they get politicians that need to further their career by hurting others.
    I’m in WV and i don’t even have to register here because only FL see’s my charges worthy of being on the registry for life
    If your young i would suggest another country preferably in Europe east of the U.K. where they actually give you a second chance

      Leaving Florida won’t help you if your objective is registry removal. And I don’t know why anyone would promote relocation from Florida to West Virginia.

      In the interest of remaining on topic, I don’t think many people here are opposed to increasing the criminal penalties for future sex offenses. It’s the so-called civil regulatory scheme that’s the problem. Practically nobody on this forum is at risk to re-offend.

        Jacob you can apply for removal off the registry in FL from any state after 25 years, you do not have to live there and states like WV/UT/VT are extremely lenient when it comes to people on the registry you don’t have to look over your shoulder every second and worry about getting arrested and thrown into jail for yet another restriction they passed the day before
        If your an outdoors man and like nature as i do WV was a great state to move to

          No hope

          BUT, people should be able to live where they want to and not have to move, just to get away from bad states. I still cannot believe that all 50 states could potentially have 50 different rules for registrants. Like some states allow easy removals and some like Florida, it is good luck with that attitude.
          For me I do not want to move away from my family and live somewhere where I do not know anyone. But everyone has to make their choices. I was not born in Florida but will probably die here. My Father was in the military, and we moved every 2 years for 23 years and we have been in Florida ever since he retired.

      Yes. I’ve looked at WV. It appears to be a great option, even with the registration fee. It’s a beautiful state.

        they have filed a suit to get rid of the registration fee and things are cheaper here excluding the heat in the winter but things like rent are 1/2 what they are in FL

    Yup, saw stuff like this coming. They are going to justify building that new 5000 bed prison, so sentences are going to be longer and it will be easier to violate the law

        You can contact FAC and if both of you agree, an FAC moderator can give both of you contact information. I did that once with the captain, but he died before we got to meet for lunch. I guess it depends on the FAC person if they want to approve it and of course it wouldn’t be posted on one of these feeds but in private.
