Caution – Make sure you know the rules BEFORE moving.
Last week, a ruling came down from the California Appellate Court in the case of People v. Morgan which should serve as a cautionary tale and reminder to make sure you know the rules of the jurisdiction BEFORE moving there!
The defendant in that case was a registered citizen in Florida who moved to California.
In Florida, sexual offenders are required to re-register every six months, during the month of their birthday and the month that is six months after. Predators are required to register every three months and Transient registrants, every month. In California, however, it’s each year “in person within five working days before or after” your birthday.
According to the defense, the defendant believed that he was able to update his registration (he did register upon moving to California) at any time during the month of his birthday. According to the prosecution, upon initial registration he was given a list or rules that he signed off on.
His conviction was affirmed.
Bottom line; if you intend to move someplace, make sure you are familiar with the registration requirements. If you are made to sign a list of rules (as you are in Florida), make sure you get a FULL PRINTED COPY of everything you signed and then review it.
