FAC Weekly Update 2026-05-21-Together, We Fight Back: FAC Announces Historic Registry Challenge

Dear Members and Advocates,
This week, FAC is proud to announce a major step forward in the fight against Florida’s Sex Offender Registry. FAC has retained the law firm of Winston & Strawn LLP to bring a constitutional legal challenge against the Florida Registry system, specifically in response to the recent passage of SB 212/HB 45.
For many in our community, this last amendment to the registry was the straw that broke the camel’s back. It represents yet another expansion of an already bloated and punitive registry system that has long abandoned any meaningful connection to public safety, rehabilitation, or constitutional fairness. Instead, Florida continues to double down on policies that isolate, destabilize, and punish people indefinitely – often decades after they have completed their sentences and rebuilt their lives. Enough!
This challenge will be led by attorney Michael Kimberly, one of the nation’s most respected appellate and Supreme Court advocates. Michael is widely recognized as a leader of the Supreme Court bar and was identified by Reuters as part of the “elite cadre of lawyers” who dominate Supreme Court advocacy. Over the years, he has earned national recognition for his appellate work. Importantly for FAC and our mission, Michael has extensive experience designing and executing affirmative constitutional challenges against state regulations. His work has involved critical constitutional issues that go to the very heart of the registry debate. Michael is a graduate of Yale Law School, where he served as an editor of The Yale Law Journal and later taught Supreme Court advocacy on the Yale faculty from 2015 through 2026.
This is the kind of fight that many people have dreamed about for years!
But bringing a challenge of this magnitude against the State of Florida is an enormous undertaking. Quite frankly, it would be impossible for any one of us to carry this burden alone. That is why we are asking for your help. This litigation will require tremendous financial resources, expert support, research, filings, and long-term commitment. FAC is stepping up to make this happen, but we cannot do it without the registrant community standing together behind this effort. Speaking of donating. I got an email yesterday about updating my donation information from FAC. Are these emails legit? Or more scams?
They are legit. When we updated our site (we’re talking a year ago already) a lot of people were on recurring billing. That has to be updated. Plus, a lot of people have simply changed their information since signing up. If anyone is uncomfortable doing something online (or can’t be online to begin with), just call us and confirm.
We have really, really, really been putting in a lot of effort on all fronts to posture for this case. From calls to action, to having people in Tallahassee, to public information requests, to expanding our online presence, to developing more support groups and programming, all in an effort to bring as many people to the table as possible. I can’t say whether it shows or not, but as someone working behind the scenes on this one, a lot of people are busting their asses to make things happen and everyone, including you, Pariah, are playing a role, so I appreciate it!
I get paid every 2 weeks so my next check I can donate a little. I can’t do much with a mortgage and two kids lol but this is awesome news!
This sounds like good news, but caution is recommended to anyone counting on it. For years we have seen countless challenges to the registry, some with fantastic legal, common sense, and evidence backed arguments..all denied by courts. It all goes back to whether or not the law is PUNITIVE..the courts have ruled consistently that it’s a civil penalty. Until and unless you can get past that hurtle, any challenges will most likely go nowhere. The good news is that if someone can successfully challenge it in Florida, of all places, it would have to carry over into all the other states as well. But unless the challenge can prove that the law is PUNITIVE (Which we all know is true), all this is going nowhere. I truly hope hope someone can turn it around, but after everything that’s been allowed “by law”, I have no faith in the Justice system.
This is great news. I believe what needs to also be brought to the attention about the dangers to the registrants of having it public as well. The person”s” who have also been killed, the Scams “Because all our information is out there”, Ect. The registry needs to be abolished. It is punishment when we already have paid in full our crimes. That is what Prison and Probation is for not to be older develop Demintia forget to regester and be put back into jail and prison. “Enough is Enough”
