Dear Members and Advocates,
For those of you who joined our monthly member call last Thursday, you learned more about our forthcoming legal challenge to Florida’s sex offender registry. This is a lawsuit that we sincerely believe has the potential to bring meaningful relief to registrants throughout the state and potentially nationwide. Registry issues that have affected our community for far too long and we’re doing something about it!
As many of you know, asking for money is not something that comes easily to us. Frankly, it’s uncomfortable. We would much rather spend our time advocating, educating, litigating, and supporting our members than pleading for donations. But the reality is that FAC is a nonprofit organization, and legal challenges of this magnitude simply cannot move forward without financial support.
The lawsuit we are preparing is not for the benefit of one individual. It is being brought on behalf of the entire registrant community in Florida. The issues at stake affect tens of thousands of people and families. At the same time, the costs associated with mounting a serious legal challenge are substantial. Six-figures substantial! No single person among us could reasonably be expected to shoulder that burden alone. That is why we are counting on the collective support of the community that stands to benefit from this effort. With unity comes change and with this weekly update we are calling on all of us to come together.
If everyone who will ultimately benefit from this challenge contributes what they can, together we can make this lawsuit successful. Whether your contribution is large or small, it sends a powerful message that our community is invested in fighting for meaningful change.
In recent weeks, we have also been reaching out to members whose recurring donations need to be updated in our system. Unfortunately, the response has been disappointing. Recurring donations provide the stable foundation that allows us to plan, budget, and commit to long-term advocacy and litigation efforts. We also recognize that not everyone is in a position to make a significant financial contribution, but still want to help advance this lawsuit in any way possible. There are many ways to help. If you have experience with fundraising, know potential donors, belong to organizations that may be willing to support our work, have participants in group who are not aware of FAC, or simply want to volunteer your time to help us raise funds for this challenge, we would love to hear from you. For more than a decade, FAC has fought for fairness, truth, and constitutional protections on behalf of you and your family. Our volunteers keep you updated on the laws, organize support groups, meet with your lawmakers, show up to legislative meetings, dispel public misconceptions online and offline, support research and litigation, provide resources and referrals, and advocate tirelessly to end this unconstitutional and irrational nightmare. This upcoming challenge represents one of the most important efforts we have ever undertaken. Success will require all of us working together.

Thank you fac for your continued approach to fight for the rights for the registrants and there families if we are successful in the lawsuit will the families and registrants of the unconstitutional ex post facto law be compensated for all there pain and suffering.
My guess is that’s the very reason the courts have been trying their hardest to deny the fact that they have been violating ex post facto all along… If they ever admit the truth, every state in the nation would be bankrupt!
Another thing I noticed and wanted to ask others about: does your sheriff’s office have very limited hours for registration reporting?
In Hernando County, the registration office is only open from 8:00 a.m. to 12:30 p.m. and then again from 2:00 p.m. to 3:00 p.m. That gives registrants only 27.5 hours per week to report.
Meanwhile, if you look at the hours for felony reporting, that office is open from 8:00 a.m. to 3:00 p.m.
Does anyone know whether these limited registration hours could create issues with the 48-hour or 72-hour reporting requirements? It seems like having such a small reporting window could make compliance more difficult.
Absolutely…FAC members in many counties have been struggling with this problem for quite some time. I would not be surprised to see it mentioned in our next lawsuit.
Good thing registering is just a civil remedy, and isn’t an extra burden added to your conviction. If the courts didn’t say so, you might actually think it is!

First off thank you for trying again to give us some relief. I have given in the past and want to now. However, I think what a lot of people want to know is what is in this challenge that is going to be different than the last.
Also, Do you have a reading on Gyms with pools, like LA Fitness, Planet Fitness Etc. Do they fall under this new law?
I’d like to know the same, what is different? What are the specific claims? Is this an ex post facto claim? Due process? Cruel and unusual punishment? Equal protection?
Legal theories and arguments cannot be disclosed publicly in advance of the lawsuit being filed for obvious reasons. The challenge will include Ex Post Facto (retroactive application), Due Process (notice and vagueness), Cruel and Unusual Punishment (banishment).
There is an element of vagueness to the Statute that we will be challenging, but our belief is that pools at gyms meet the definition of Public Swimming Pools (unless the gym bars people under 18 from using them).
Thank you for that Info. So I can still go, right? But just don’t talk to anyone unless they have a full beard and grey hair. LOL.
There’s no state law against just going there that I am aware of.
Also, Planet Fitness (unlike LA Fitness) doesn’t even have pools, right?
Even these wins would only set presidence correct for changing of the laws too?
These wins would change the laws in Florida. They would be persuasive elsewhere and if appealed to the 11th, would become binding precedent in FL, GA, AL (on identical issues) and persuasive across the US. If it goes to the Supreme Court of the US, it becomes the law of the land.
What exactly is the lawsuit challenging? I haven’t seen any specifics so just wondering. I’m tier 3 in Louisiana so it won’t affect me directly unless it goes to SCOTUS. I certainly wish you the best. My conviction is from 1995 and I’m registered for life. It’s a hard pill to swallow and I keep hoping for relief. The Doe v Lee case in Tennessee will hopefully make it to SCOTUS and if they get the relief they want that would free me from the lifetime tyranny of the registry.
Good clarification thank you I knew it had to get SC but that shows the path. I know this isn’t out 11th but did not Michigan see its sex offender registry as unconstitutional. If so this would help us if it was by chance picked up by the Supreme Court
