Notice of Appeal Filed in Does 1-5 v. Swearingen (Ex Post Facto Plus I)

A notice of appeal has been filed in the original Ex Post Facto Plus case that was dismissed a couple of months ago. The case will go before the 11th Circuit Court of Appeals.

A separate case, Doe v Swearingen (Ex Post Facto Plus II) was filed last month in the Northern District of Florida. Both cases are moving forward simultaneously with the same legal team.

    Good day!

    It seems, by a conversation I had with FAC that a lot of folks who post are not members, and that’s alright.

    But we get lot of advice, about what FAC should do. And some of it is good some not so good. FAC wants to do more but it often comes now to what I call the PEST.

    People, not enough willing.
    Economy, not enough funding.
    Space, like offices, goes back to E
    Time, goes back to P.

    If every poster were a member and gave a little bit of the above there would be no PEST!

    A few carriers the load, and grows weary. But more carriers a little bit and all accomplish more.

      Just wondering is this a members only organization? I would also like to know if only members give donations or are non-members also giving money. Not enough funding? What’s the Total Amount raised for this case? Does a homeless sex offender that can barely keep himself fed because of a scarlet letter on his license have the same right to speak as someone fortunately enough to have a job? Maybe non-members voices should be canceled. Or maybe we should practice having more fortitude and empathy. And I mean real empathy for people situations and not pretending to be empathetic because you carry the same criminal status. I have a complaint and it’s people Not staying on topic as comment policy. Maybe it’s okay for paying members.

      Sorry for the frustration, but the pleadings have been listed ad nauseum in postings on this site. They were discussed on several monthly member calls, including last month and covered in numerous weekly updates. I checked the member roster by your email and we don’t have any record showing you are a member. Perhaps you might want to consider joining and then you will receive the updates and can join the calls?

      Both cases can be looked up in Pacer.
      Does 1-5 v Swearingen is Case No. 18-24145-Civ-WILLIAMS/TORRES – (This is what we are referring to as Ex Post Facto I)
      Doe v. Swearingen is Case No. 4:21-cv-00085-RH-MJF – (This is what we are referring to as Ex Post Facto II)

        Hi FAC, I see from PACER that thses cases have been filed in the Southern and Northern Districts of Florida. Will any of these types of cases be filed in the Middle District of Florida? Or am I on my own to find a lawyer to do it in Orlando?

    I thought the 11th circuit already reviewed and dismissed the 1st case. It is going back to the 11th again ?
