PA: PARSOL: SORNA’s internet identifier provision is ruled unconstitutionally vague
On Dec. 3, 2025, Judge James J. Panchik of the Court of Common Pleas of Armstrong County, ruled SORNA’s internet identifier provision is unconstitutionally vague. The Com. v. Michael Diebold case arises from a new failure‑to‑provide‑accurate‑registration‑information charge filed after the defendant, in litigating a habeas petition in an earlier SORNA case, disclosed a list of 66 websites he used and a Craigslist email exchange about brush‑cutting services. In response, PSP and the Armstrong County DA treated both Craigslist itself and a Craigslist‑generated relay email address as “internet identifiers” that had to be registered within three business days under 18 Pa.C.S. § 4915.1(a)(3) and 42 Pa.C.S. §§ 9799.15 and 9799.16.
The defendant moved to dismiss on multiple grounds, including lack of prima facie case, due process, vagueness, de minimis, and malicious prosecution, but the court resolved the case solely on the statutory‑vagueness issue as to “internet identifiers.”
NOTE: This is a PA trial court decision and has no precedential value or application to Florida.

Unfortunately in Florida, there’s such a county, where you have to literally drive, walk, etc. completely around such an area, as to avoid a proximity violation offense.
Tereto
In fact, there are Numerous counties like that. Polk, Volusia, Osceola and several others that go way beyond the registry guidelines and get away with it with no consequences.
Also did this comparison:
eBay and Etsy are considered commercial platforms, not social sites.
Here’s why:
🛒 Core Purpose
– eBay → Online marketplace for buying and selling goods (auctions + fixed price).
– Etsy → Marketplace focused on handmade, vintage, and craft items.
– Their primary function is commerce, not social networking.
💬 Communication Features
– Both allow direct buyer-seller messaging (questions about products, shipping, customization).
– This is transactional communication, tied to commerce.
– Unlike Facebook or Instagram, the messaging is not designed for casual social interaction—it’s meant to support a purchase.
Telehealth platforms are not “social sites” — they’re classified as healthcare service platforms with communication features. Let me break it down clearly:
🩺 What Telehealth Is
• Primary Purpose: Deliver medical care remotely (consultations, prescriptions, monitoring).
• Core Function: Connect patients directly with healthcare providers (doctor-to-patient, therapist-to-patient).
• Examples: Teladoc, Amwell, MDLIVE, Doctor on Demand, Zocdoc (for scheduling + virtual visits).
Hope this clears the muddy waters a bit.

Whoa, I never thought about my Tele-health as a potential FTR lol

They are doing all this as a tool to get us all locked back up or at least back on paper like probation. It is becoming so hard to know what we can and cannot do that at this point, I could care less. I am going to live my life and register when it is my time and that is it. Adding more and more and more onto us is just plain and simple malice and hate.
And the worst part is, most judges say NONE of it is punishment or punitive in nature.
@CherokeeJack
It’s seriously getting to the point where I don’t leave the house(and when my father dies I’ll be homeless) unless it’s to go to the courthouse to do registry stuff. I get crazy anxiety about a potential violation for taking a jog around the block or going to get a haircut(and I insist on paying everything I can with cash). I’ve been on the registry for a little over 10years. This way of life is starting to affect my health. Anyone who was previously military personnel can relate. We have a routine to maintain that was Kind of beaten into us. Only so much you can do confined indoors 24/7
Will be 20 for me in Jan Ret. No end in sight. Going to take more than a mustard seed to move this mountain.
@RET SGT
I was born on a military base and my Dad served for 27 years. Although every person is important, anyone who served in military whether they came home or not, deserves respect. I tried to enlist but at the time there were no wars, and they were looking for people with bachelor’s degrees or specialty training.
I am glad you are on here (F.A.C) because I consider all of us family, because we are all in this fight together. It might not be a campaign fight overseas but rather a fight for justice as we have served our time on paperwork. I have been on the registry longer than my entire sentence, 29 years on registry come 2026.
If you need a friend (Since I grew up in a military family) you have my permission to ask FAC for my email address, I do not want you to be alone, at the very least to have someone to talk to by email or phone. 5 of my relatives served and I lived in Navy housing for 14 years of my adolescents. Dad and his two brothers were in Vietnam.
The county I live in, they never give you any crap unless you give it to them. Both the registry office and the deputies who come to check on me are all nice. And un-like some counties come with 2 or more deputies, I always just get one and he (And sometimes a she) are always respectful and ask if I have any concerns, issues or problems.
Stay strong and do not give up or give in. It hurts, we all know the pain, but some have it better and some have it worse. We need to support each other. I wish I had met the Captain in person but he passed away before we got to meet. I felt horrible that we did not get to meet before he passed. Only a handful of people on here I trust to meet because you never know, someone could be law enforcement trying to trip us up.
@CherokeeJack
Thank you, that means a lot. I’m very grateful for the fellowship I’ve found here on FAC. The problem I’m facing is that I will outlive the few people in my support system by 20years or so. All avenues seem to point to prison.
I’m grateful for what I do have; I’m particularly grateful for my psychiatrist. She’s young, but she goes above and beyond.
The thing is they know my background and expect me to be armed. My checks are always 2or more. Usually its 6+, once it was a whole class of police academy cadets and Instructors. It was so many of them the line went out and around my apt building. It was super embarrassing for me. I stepped out and down the hallway, I jokingly said “You all waiting for back up or is this enough?”
*Sigh
Telehealth is not something you need to report. Really eBay shouldn’t be either. I was told that I had to report eBay, so I do. They also told me if I ever started to sell on eBay I would have to list it as a business. My point of this exercise was to show how easy it is to get a list of Social Internet communication sites and Apps (see other post as well). So surely our esteemed colleagues in Tallahassee could do this as well and then codify it. That way we would know what to report and what does not need to be reported.
@tearfuleagle
I feel that. *smh
