Should this be Rape?

Here’s the scenario…

An 18 year old and 15 year old are at a party. The two know each other for five months. The 18 year old gives the 15 year old a ride home from the party and as teenagers sometimes do… one thing leads to another… and they have sex.

Only, in this case, the 18 year old is the female and 15 year old is the male.

18 year old is arrested and charged with Rape and Sexual Assault by a Custodian (since the 18 year old was giving the 15 year old a ride home).

By both participants accounts the sex was consensual.
