Texas city passes residency restriction to banish registrants
Politicians are becoming more brazen in their actual reasons for passing sex offender residency restrictions.
In this news story, the sheriff was quoted:
Chief Landon Swan of the Hereford Police Department explained the rationale behind the ordinance, stating, “What we’ve found is if we utilize all these different locations with the 2,000-foot radius, it actually lets us cover almost the entire town.”
Really? That’s the rationale?!?

Yes. Banishment is one of the traditional forms of punishment mentioned by SCOTUS in its 2003 Smith v. Doe decision.
“Even punishments that lacked the corporal component, such as public shaming, humiliation, and banishment, involved more than the dissemination of information. They either held the person up before his fellow citizens for face-to-face shaming or expelled him from the community” (emphasis added).
The Hereford ordinance looks a lot like traditional punishment. The civil regulatory veneer is wearing thinner all the time.
But, when the Supreme courts think they are gods and make it so, no matter what they say, it becomes law. I mean other than God Himself, who has more power than the supreme court? Where are the checks and balances.
In my opinion, maybe they should look at a dictionary and see what the word punishment means.

The infliction or imposition of a penalty for an offense. or rough treatment or handling inflicted on or suffered by a person or thing.
Earnest died over 100 years ago. If he is in Heaven, maybe he could put in a good word for us with God about sending the registry to Antartica, or a Volcano.

That 100% sounds like PUNISHMENT to me. The more harsh the restrictions become the weaker the argument that they are not punishment. Clearly, the “rationale” supports that they have completely forgotten, or are blatantly ignoring, that this whole schema is administrative, not punishment.

Not to get political but I think some of them are becoming emboldened because of the things Donald Trump is doing. He is kicking people out the country are who legal citizens (In some cases) and have no criminal record. In some instances, the person was born in the country and was sent away anyway.
There is an old saying, “Things will get worse before they get better”. I think we are experiencing that now.

Ernest Shackleton endured Antarctica. I look to him for strength in dealing with the registry.
Only 1488 people live full-time in Antartica; In the Summer time population goes to 2997…..For 4 months there are No Fresh Fruits and Veggies because you cannot fly a plane there…Cherokee, there is not a Tribe there but perhaps you could set one up; you would not have to register there; what would the Sheriff Person say to you when you are headed to Antartica? I can see the person thru the Glass window typing on a Key Board and getting nowhere! The Person Behind the glass window will look like a jerk! We do not know who the people are behind the Glass Window…They know our names, but we can only presume that their names are Taxpayer Abuser!
I do not particularly like the cold weather so I guess I will take a pass on that offer LOL
Having said that, I do not particularly like when it is 100 degrees in Florida either.
No matter where you live it is something. Tornados, Hurricanes, sinkholes, Mudslides, fires, Floods, Volcanoes, snow and ice storms, hail, and more. No place is perfect. And no matter where you live, someone has to ruin it for everyone else.
I’m OK with that. (Sending y’all to Antarctica.) Nothing of value would be lost.
