Judges that use unreported offenses as part of their justification for a particular ruling should be removed from the bench, using such data is a clear violation of innocent until proven guilty.
An unreported offense is a nothing more than an accusation, not saying that they have no merit or validity. Simply saying until it has been investigated and or prosecuted it’s only an accusation.
If it’s “unreported” it cannot be confirmed and therefore not proven. The “unreported” statistic is a fear mongering tactic and it works.
I can say that people are abducted by aliens several times a day but they go unreported. That’s literally what hearing someone say “unreported sex offenses” sounds like to my ears.
Besides, has anyone ever bothered to ask how there is a statistic for something that hasn’t been reported? Ah, the things that make you go “Hmmmmmm”.
This misinformation has ruined life’s. So let me be super real, this holds true for me and probably many more. Was there a crime, a wrong doing, a reason for jail or prison time? Yes. The judge sentenced me to prison followed by probation. Was it fair? It wasn’t the max, and I took the plea, so sure I’ll say it was justified. I was told I would be on the registry in 2006. But I didn’t agree or plea too ask the additional requirements of the registry. I am the worst person according to much of society. Even though I’m an honorable fully disabled veteran. Even though I’ve been successful in work, a good father to my step son, and soon. A homeowner, a faithful husband, and some have told me a good friend. None of that matters. I struggle with self harm issues from my time in the army. The registry does not make it any better. I moved out of Florida for work opportunities due to covid. Again, all the above still applies but doesn’t matter. I got a new tattoo, did they thing to let the officials know. I’ve been very down lately, I asked what would happen if I was made to go inpatient for my own safety. I was told I would have to go in and register the information and do the same in the other county to stay in compliance. Not sure if anyone understands, that if I were made to do this I wouldn’t be able to leave to register. So I would be in violation and might go to prison. Let me say it plainly, I would go to prison because I was a risk to society, by going somewhere to protect me, from ME. As of today, I’m ok. But I honestly don’t know what the future holds for me. I’m not hurting myself because of the registry, but how does the registry protect? It puts us all in harms way, from society because it’s easy to find us. But for me, it does not allow me to protect myself from me. I don’t see how that’s fair.
Where is the Empirical Data related to Recidivism Rates (from Numerous Sources) that Justice Kennedy relied on? Psychology Today is a Supermarket Tabloid Similar to The National Enquirer, Star, etc….

Big government fans have no concern for facts. They just love the Registries because they cause problems. That’s the point and that is why Registries exist.
