Bad News: EPF I Dismissed Again
We just received the upsetting news that the “Ex Post Facto I” case was dismissed AGAIN! This case was originated in 2018, dismissed, appealed to the 11th Circuit, remanded back to the district court (the same court that originally dismissed it), and was set for trial in a few months. The district court has once again dismissed the case. The order is below.
Attorneys Val Jonas and Beth Weitzner, who along with others, have dedicated nearly a decade to this challenge, are not giving up and as soon as this order is digested, will be coming up with next steps. We will keep you informed. In the mean time, this is very upsetting news for our population in Florida.

Mr President time to repeal SORNA. It’s a witch-hunt hoax.
Long been this way for more than the ages. It is will documented and known by those on the judicial side of life and others who aren’t know what you say is the truth.
It seems that this Court really doesn’t want to hear the case. After their initial dismissal it was referred back to them so they came up with another way to not hear it. Once again filing an appeal to the higher Court that the dismissal was wrongful should allow a change of venue as this Court shows prejudice against the case.
Nobody that has a brain, could honestly say that the ex post facto violation doesn’t exist.
Rebuking the appeals court after being sent back is definitely reason enough to seek change of venue.
Is a Motion to Reconsider using the standard established by a unanimous SCOTUS under Ellingburg v. United States (2026) a proper vehicle to preserve the ex post facto/due process issues on appeal?

Colorado if your tier is right. Going there end of May. Have to register only one time a year one like to your door. After 10 years can petition to remove from original offense. And 7 years from last offense for employers to use against you

In Colorado, many employers generally look back 7 years for criminal convictions during background checks, often calculated from the date of disposition or release from probation/parole. While felonies can stay on records permanently, the 7-year standard applies to reporting by consumer reporting agencies under the FCRA for jobs with salaries under $75,000.

Salary Threshold: The 7-year limitation on reporting arrests or convictions generally applies to positions with an annual salary of less than $75,000.
Exceptions: Longer lookback periods may apply for higher-paying jobs, positions with fiduciary duties, or roles requiring bondability.
“Ban the Box”: Colorado law restricts employers from asking about criminal history on the initial application, often delaying the background check until a later, conditional offer stage.
Sealing Records: Felonies can be sealed 10 years after the final disposition or release from supervision (whichever is later), but some violent crimes are not eligible.
Better check the county you want to live in before you get to CO because the entire state is not what you write.
There is no answer to which state is the “best” for us because all suck in their own way. However, when you’re already arguably in the worst state in the US (and not just because of the state’s registry laws), there’s nowhere to go but up. Although, moving to a handful of states like Alabama might feel like a lateral move rather than upward.
I was thinking, Vermont, Oregon, Colorado, Heck even Georgia. Has much as I hate to say it: When this broke in 1995 I never felt hopeless. When I was sentenced to 42 months, I never felt hopeless. When my PO tried to violate me twice, I never felt hopeless. While I was doing my 9.5 months out of 10 years of probation I never felt hopeless.
Today I feel hopeless.. The only way to describe how I feel today is basically “I don’t care anymore. About anything.” Totally feel like I am in a pitch black room and cant find the door.
Sorry to be so negative but I really thought Ellingburg would start to set some of free. I 9 more times to report and I can apply to get off but at this points its $20k wasted. When I could live off of that for a year in some countries.
To be truthfully honest when I was in colorado I forgot I was on it lol except for like occasional occurrence like finding swiming for my son and the YMCA policy is there from florida. No license markings or ID markings. You report tier 1 which would be most in florida sex offender for predators usually start tier 2 restrictions and about which still are nothing like florida. But tier 1 is 10 days from day of birthday you have to report to a clerk make sure Info right pay 20 but that the clerks fee for anyone not registrants. After the sex offender officer which just so you all know I picked his brain know him well. He went to and you have to being the areas sex offender officer to enforce state sorna regulations go to training. He said with training and corresponding training to understand regulations yes he uses regulations about 2 years all together decides on standard police officer school also has bachelor’s in criminology specifically sex offenses. This is huge for very knowledgeable person and he says he is there to protect the registrar as well as public too with regulations and policy. So he called kw while camping. I told him our camping how long do I have to report so I dont violate. He did not ask me where I was said tell me when you get back by calling his work cell and we will meet up for the in person spot check. I called him 2 and half weeks after and he came out knocked on door asked how my vacation was and on his way. There are civil rights in the country still and people who are nice genuinely. I can help anyone with this transfer by answer questions. It is scary I didn’t pay my mortgage in florida to get to colorado for 16 months so I could afford to get my family there got my house in and out of foreclosure . Lived in a Travelodge which has 1 and 2 bedroom options with no issues with reporting. Employment is have some connections there one is just loading mattress at night but pays 30 an hour posted right now in colorado too.
In Colorado If i was say Tier 2, pre 97 what from your knowledge would be restrictions. I can work from anywhere in the US so that is not a problem. Do you know the names of a good attorney that could look at my Florida case from 1995 and compare it to Colorado?

Tier 2 in colorado is just annually usually and the worst let’s sag tier 3 would be ever 3 months registering. But I’ve only see that got tier 3. Truthfully the tiers in colorado is the time you have to stay on since last released from probation, parole, and or jail. Tier 1 is 10 years you can petition not to have to register annually and no annually spot check at home. Tier 2 is ever 3 to 4 months at clerks and one spot check even. Now for checking on your stuff. Mine was el paso country colorado so I contacted the Sex offender Unit which got me in touch with the officer. He said send me your stuff I’ll check see what tier I was for they have to send down to florida to check as well. I was tier 1 did this in person after talking. He did his investigation on what tier I would be based on colorado law and what I was charged with in florida and I was also at 9 years did my petition also to not have to register in colorado as well. Well had to come back florida got paper felony and im on my way out selling house getting back to colorado. Also I do know air bnb websites you can use that let use us as SO use them to book and they give temporary leases this counts in colorado. Also RVs there can be used as homes and residences so you can do many things not to be transient having to go in ever month
On no paper felonies in florida literally used my florida driver license at clerk to check in too. Had address of florida just asked me where I currently was staying. Do not lie for the officer if you need to come in update anything will just call and schedule you in. Also know you can see a warrant on colorado by just searching your name not like here lol but the officer has the options if it’s a “Knowingly” violated notice that knowing or evading SNORNA laws of colorado and judges can make judgments on punishments to like its a not a felony just a fine they have more options than florida tied with laws
So your offence was in Florida and you moved to CO. I am confused. But appreciate the info. I would be Tier 1, Tier 2 at worst and I am already over 20 years here.
Yes I got a 2015 arrest in florida for net nanny sting and just communication no meeting happened so that landed me on florida sex offender registry and felony. I exited florida in 2023. Got job colorado and all. Had to come back shortly to help my middle son for his mom was on drugs in florida. Got another paper felony not trying to get one but yeah and just got off am making my way back to Colorado. I had to maintain my apartment under contract in colorado as they had me under a felony here. Luckily I still owned house which im selling now for I want nothing to do with florida. Might rent it if right too maybe to registrant to help idk. But I dont want to step foot back in florida after may when my youngest son finishes kindergarten. But I already done the path to move out there. Have connections and lived there for over a year under their state laws. So much better. When florida FDLE caught up with me they called the officer in Colorado Springs that comes to do spor checks also is the sex offender officer for my area. He did try to get them send me back to him but yeah florida had me on forgetting to go register my RV sale to the SNORNA office correctly. Paper felony for I have TBI from deployment didn’t do it knowingly at all. Well long story there too.
Sorry all that happened to you best of luck to you back in Colorado. But when you get back you should be able to get off in Colorado right?
Eventually yes tier one can petition after 10 years to get off their registry. But will be forever on Florida’s registry right now which I love to travel in my RV so I have to always keep up on laws in states and provinces for life anyways like anyone in florida life and now since paper felony lost my petition for pardon or clemency here in florida. Remember tier 2 is 20 to 25 years from first conviction you can petition get off too. We need to start and i hope to help once im am back in colorado getting members to help others transition. Its scary going to another state. I’m seasoned lived in 17 different states I was military lol and overseas. But doing it alone is scary I can help
