Is your sheriff’s office asking you to disclose additional information?

After posting a story yesterday about (which you can find here) a lawsuit in Arizona challenging a State Law that requires the registration of one’s children, we learned from some members in Marion County, Florida, that their Sheriff’s Office is doing the same.

According to member reports, the Marion County Sheriff’s Office requires the registration of people’s children (including their names and ages), their Girlfriend or Boyfriend, and anyone else living in the house.

To our knowledge and belief, that information is not required to be disclosed under Florida Statute Sec. 943.0435 or any other related statute. If anyone can find information to the contrary, please let us know.

It is our position that adding children or dating partners introduces sensitive personal data not relevant to public safety and potentially exposes the registered children and boyfriend/girlfriends to undue scrutiny or privacy violations.     Upstate in New York there’s a small City that when you register ask is an immediate family member in the area and that person’s location, and what means of travel did you use to come in to the office to register. That’s not part of the registry information requirements.

    In the month of July, Miami-Dade county asked for a couple of additional points:
    *Place of birth (will we be deported next?)
    *Time when I will be home so they can verify my home address

      All that spot has been on the registration form for years.

    There is a form you have to fill out that asks things like blood type, the name of kids living at home, whether they’re in a relationship, THEIR names and more. I’d send you a Pic next time I check in, but I’d be afraid I’d get more attention than I want

      That’s not required under Statute. They can legally ask for any information that they wish however they cannot require it. Please check the printed copy of your registration that you initial at each registration and compare it to the FDLE requirements. There was a situation out of highland county that they possibly rewrote the requirements. It’s always best to review the Statute vs what they hand you.

    I live in Marion County, they ask all those questions and more. My son was visiting from out of town, when they came by and ran the plates. My name was on his registration, so I was arrested. Charged with a felony and my court appointed pretender just said to take the deal of 18 months of house arrest instead of 2 years in jail. He would not even try to argue the fact my son does not live with me.

      Al. The fact that he does not live with you is irrelevant. If, as you say, when they “ran the plates[, your] name was on the registration”, that’s the problem. Under the law, ““Vehicles owned” means any motor vehicle as defined in s. 320.01, which is registered, coregistered, leased, titled, or rented by a sexual predator or sexual offender; a rented vehicle that a sexual predator or sexual offender is authorized to drive; or a vehicle for which a sexual predator or sexual offender is insured as a driver. The term also includes any motor vehicle as defined in s. 320.01, which is registered, coregistered, leased, titled, or rented by a person or persons residing at a sexual predator’s or sexual offender’s permanent residence for 5 or more consecutive days.”

      So if your name was on the registration, that’s all they needed to convict you. I’m writing this for the benefit of those reading this who would think otherwise by reading your comment.
