Motion Filed to Stop Implementation of International Megan’s Law
A Motion for Preliminary Injunction was filed on February 19 asking the U.S. District Court to stop implementation of International Megan’s Law (formerly HR 515 and now Public Law 114-119). If granted, the motion would temporarily prohibit the federal government from both adding a conspicuous, unique identifier to the passports of registrants and notifying foreign countries of registrants’ plans to travel internationally.
Six declarations were Included with the Motion, including declarations from the Association for the Treatment of Sexual Abusers (ATSA), Dr. Tom Tobin of Sharper Future and criminal defense attorney Alex Landon. The declarations of by ATSA and Dr. Tobin included statements that International Megan’s Law will not halt child sex trafficking and could result in significant harm to hundreds of thousands of registrants.
“We are grateful for the support of ATSA in our efforts to stop implementation of International Megan’s Law,” stated CA RSOL president Janice Bellucci. ATSA is an international organization dedicated to preventing sexual abuse through research, evidence-based practice, public policy and community strategies that lead to the effective assessment, treatment, and management of individuals who have sexually abused or are at risk to abuse.
A hearing date of March 30 was requested when the motion was filed. The federal government’s response to the motion is currently due on March 4, however, both dates could be postponed if the government requests a delay.

I don’t know too much about Mary Perry Miller; but I have heard from other registrants from as far back as 20+ years who have complained of the degrading manner Tom Tobin has treated, errr… rather, mistreated them. Any protest or objection to Tobin’s methods (however unethical or wrong) or sex offender laws were met with reports to probation officers and/or removal from group “treatment” setting. Tobin just can’t pretend he wants to change the laws for the better after the guy’s got (God only knows) a ton of blood on his hands. I mean look at the tiered registry Tom Tobin cheers for; its based on tons of exceptions that would still require lifetime registration periods for many people. IF Tom Tobin wants to help registered citizens, it will never be solely to help them. Tom Tobin, like a true selfish coward, will only support law and/or policy when it helps his interests: whether for Tobin’s profit and/or power.
I have heard from a few others, when Tom Tobin and Mary Perry Miller were at The Center for Special Problems (before it closed) and now at Sharper Future, that removal from the group setting was (and is) a common practice anytime a person objects to the unfairness or mistreatment under their company or unfair law. It’s really an abridgment to free speech and a violation of civil rights when you think about it. Of course Tobin and Miller could care less to the slippery slope practices they partake in, so long as they retain their befouled state contracts. But Sharper Future often rationalizes removal for fear that one might have a “contaminating influence” on other group members. I have also heard removal is also rationalized with less than honest testimony from the “clinicians” from The Center for Special Problems and Sharper Future. I have heard inaccurate exaggerations and nitpicking a common unethical practice of those at both companies. Again, I have heard this from much more than 1 person.
So if Tom Tobin is so eager to sell the Static-99R as accurate, then what is the purpose of his unethical “treatment” methods to begin with? The fact is Tobin’s degrading “treatment” methods are not necessary to help people (as Tobin may actually be harming people; but certainly infringing their rights) and are testament to Tobin’s modus operandi to pander to politicians so that he can make $$$ from the mob hysteria than anything else. Even if it means conflict of interest and selling fake science such as lie detector and Static tests. As for the Static-99R, it is statistically more INACCURATE than accurate. The Static-99R “developers” (a label they coined to make themselves only SEEM more credible than they really are) are not statisticians. Andrew Harris, Amy Phenix, R. Karl Hanson, and David Thornton are snakeoil fraudsters, mostly from Canada, who earned their credentials from places I’ve never heard of.
True. If it’s assumed people are “static,” as the Static 99R claims on its risk factors, and people don’t change: what is the purpose of Tom Tobin and Mary-Perry Miller’s business scheme to begin with? People learn and mature: the Static 99R does not take this into account. It appears Tobin advertises the Static 99R to help boost his ostensible credibility by making the Static seem scientific. It also puts a flavor of science, albeit fake, behind Tobin’s misleading tiered registry. The accuracy of the Static 99R, as well as the special interests and dirty money behind it, must be challenged! The stats behind the Static test are misleading and plainly inaccurate. This all proves our government will lie, cheat, misrepresent when it comes to dealing with people labeled “sex offenders.” What is the reason for this (aside for politicians wanting to get elected by exploiting fear, business interests, and bureaucratic career interests of law enforcement, prosecutors, and judges)?
I think you poked a logical fallacy in Tobin’s many contradicting opinions. Listen, Tobin is a fraud, so I would take anything he says with ZERO worth. I am thankful to never have encountered Tobin in any treatment setting (nor any of his companies). In fact, it’s been 12 years since my only offense and the only treatment I’ve had was about three months worth of therapy from who I consider a great psychologist NOT ASSOCIATED WITH THE STATE IN ANY WAY. Good job, happily married 5 years now, homeowner and I got a kid of my own. Not bad, though I appear an exception. I go to the CARSOL and SAA meetings, have to hear about the unnecessary crap seemingly decent people have to go through because of others in government wanting to get ahead and it gets me upset.
Jonathan, very true. Dr. Tom Tobin (is he a real doctor BTW?) shoots himself in the foot when he sells the Static scores as credible and at the same time sells a fraud “treatment” scam. The Static 99 scores don’t take into account treatment or even rehabilitative effort(s). Which is why I stand behind my family member, as well as any other person, wrongfully “treated,” as well as labeled by Pacific Forensic Psychology Associates, dba Sharper Future.
Conniving licensed clinical psychologists (who in my opinion, ought to have their psychologist license revoked) Mary Perry Miller and Thomas Joseph Tobin, President and CEO of the morally-deprived Sharper Future (a “division” of the rotten Pacific Forensic Psychologist Associates Inc.), are nothing but trash people. Mary Perry Miller and Tom Tobin are trash profiteering opportunist who have used the political hysteria against people labeled “sex offenders” to anchor their dirty and corrupt CDCR state “treatment” contracts worth millions of dollars. As many others have said, Tobin ought not be allowed to hold a CEO position of his private company while positioned as vice chair of the California Sex Offender Management Board (“CASOMB”). Tobin’s seeming conflict-of-interest gives the clear impression of government sanctioned corruption. Add insult to injury, Tom Tobin supports a fictitious tiered registry. The tiered registry relies on Minority-Report-style science, premised on the very flawed Static 99R.
Back in 2004 when I was sentenced it was still the original Static99 (no Static99R yet). I don’t know too much about the test but all I can guess is that it’s the same crap. The thing called me a high risk sex offender. 12 years later, the Static99 is proved wrong. No reoffense, as the Static99 predicted. The state should really not be so sloppy to wrongly predict someone’s future. We are talking about life and liberty here and wrongly calling someone high risk is like defamation.
Static 99 & Static 99R are bunk junk statistics. The static scores are sometimes right, sometimes wrong. Sort of like a random guess. The Sharper Future psychologists who defend the static score system are simply ignorant frauds who have not delved any deeper than the superficial propaganda fed by the steeple of Sharper Future.
“Bunk junk” is absolutely right! There is an Orwellian quality to what the Static 99/R hopes to achieve. Except the Static lacks any intelligence or sophistication making it of any use in an Orwell novel. I think the Static 99 is more fitting for the Jerry Springer Show (since all the trash TV loves the lie detector). The poly and Static 99… fit for trash TV.
Corrupt Pacific Forensic Psychology Associates Inc. (alleged) licensed clinical psychologist and Sharper Future President Mary Perry Miller, along with Chief Executive Officer (CEO) Tom Tobin seem to have proportionate visual indicators that may be indicative of their dirty company’s success in gaining its questionable CDCR contracts. For Mary Perry Miller, it’s her thick-rimmed glasses and flamboyant red attire. The thicker rim the glasses and the more red the clothes, the more blood money the pigs at Sharper Future are seeing. As for Tobin, the larger his potbelly grows, the more he eats food purchased by the blood money earned by unethical, civil rights crushing, “therapy” tactics. Or Tobin’s potbelly may be symbolic of the b*!!$*!* Tobin eats. After all, Tom Tobin seems to buy into the Static-99R, polygraph, ABEL, and no confidentiality in treatment fake baloney. It takes a lot of lying to oneself to think Sharper Future’s tactics are not wrong-headed.
So if Tom Tobin’s practices include junk methods, such as polygraph and Static 99R, that prove unscientific and flawed… what does it say about Tom Tobin as a man? He is not the credible source portrayed by media. Tom Tobin and Sharper Future, as I have mentioned, are made up of profiteering opportunists that anchor the political hysteria against people labeled “sex offender.” They are like ambulance chasers, but worse: as their (Tobin, Mary Perry Miller, etcetera) business model has the added component of relying on questionably attained “treatment” contracts financed by the dishonest crooks at the California Department of Corrections and Rehabilitation (“CDCR”). Tobin and Miller have used the political climate against sex offenders in their (for-profit) favor. Now, we must use cold hard facts to force fraudster psychologists, such as Tom Tobin and Mary Perry Miller (as well as equally deprived politicians), into a submission of shame.
LOL their ego and self entitlement are so high that they can never be shamed. As for the other enablers. . . their high salaries and gross pensions are secured by mud slinging, savage unions so you can never shame these people. Even though the politicians, law enforcement and judges ARE wrong they are too deep in their mob mentality, reaping the benefits of misinformed and corrupt power to be shamed. Everyone in power are sitting pretty, milking Uncle Sam so they will not rock the boat. . . even if ignoring the truth is at the cost of TRUE justice. When you look the grand scheme of things, very few people nowadays have good morals. And those that do don’t seem to be the ones in power in government.
Every comment here regarding Sharper Future, Tom Tobin, Mary Perry Miller, the California Sex Offender Management Board, and CDCR state parole are so true. Corrupt business and government special interests based off of fraud science and inaccurate statistics peddled by dirty self-serving politicians.
It’s pretty sick Sharper Future is free to use what is said in supposed “confidential” therapy (both in group and individual session) against a person. And how the so called “therapists” and “psychologists” portray events in a manner not reflective of reality, but too often in a twisted narrative fit to further their perverted agenda. An agenda too often at odds at the best interest of public safety, the “client,” basic civil rights — and driven to further the corrupt and greedy for-profit nature of Tom Tobin, Mary Perry Miller, their shell company and its employees (Pacific Forensic Psychology Associates, Inc.), the California Sex Offender Management Board (casomb), the California Department of Corrections and Rehabilitation (cdcr), as well as the political-hack scam artist jerks at Kamala Harris’ Department of Justice. As for Sharper Future: the conflict of interest between Tom Tobin as CEO of Sharper Future and vice chair of casomb should be troubling in and of itself.
The “Inc.” in Pacific Forensic Psychology Associates INC. should scream questions in private for-profit enterpises intermingling in public affairs that are santioned by probably unconstitutional laws. While Tobin, Mary Perry Miller and other profiting psychologists and therapists make money from sex offenders and draconic laws, our Constitution (as well as the God given civil rights of people who have served their criminal sentence) is further eroded. This is a very important factor the Sharper Future cons and lie detector examiners conveniently ignore. But as some others mention, history will prove dirty therapy methods wrong. For Tom Tobin, his support in the challenge against IML has come too late, as the people who have at least a half decent memory will remember the sex offender hysteria Tobin not only helped create, but the money and unscientific methods (polygraph, Static 99R, ABEL, no confidentiality in treatment, etc.) Tobin propped.
Props. Not past tense. Props. As in Tom Tobin and his unethical employess still “prop” static 99R, lie detector and (as equally unethical Mary Perry Miller put it) “no secrets” type (zero confidentiality) “therapy,” “treatment” … or whatever the hell the corrupt, self-serving CDCR losers (paying the multi million $$$ contract to Tom Tobin, via his concurrent California Sex Offender Management vice chair sham-position) put it as. By paying Tobin, Perry Miller and company big bucks, CDCR can convieniently outsource their oppressive, bad-karma-laden, jobs to the Sharper Future “clinicians” who have sold their soul to corrupt and dirty causes. Most troubling is that most probably see little wrong in the terrible, slippery slope work that they do. It earns a decent paycheck after all.
Arnold. . . what you say seems to be the pattern I hear when I go to all the meetings. When people go to what is claimed as treatment with the hopes of being somehow helped, and they are otherwised backstabbed by psychologists or whoever. . . who can they REALLY trust? But yea. . . at the meetings I go to people complaining that sex offender treatment psychologists are not at all accurate but exaggerate and nitpick.
