Motion Filed to Stop Implementation of International Megan’s Law

A Motion for Preliminary Injunction was filed on February 19 asking the U.S. District Court to stop implementation of International Megan’s Law (formerly HR 515 and now Public Law 114-119). If granted, the motion would temporarily prohibit the federal government from both adding a conspicuous, unique identifier to the passports of registrants and notifying foreign countries of registrants’ plans to travel internationally.

Six declarations were Included with the Motion, including declarations from the Association for the Treatment of Sexual Abusers (ATSA), Dr. Tom Tobin of Sharper Future and criminal defense attorney Alex Landon. The declarations of by ATSA and Dr. Tobin included statements that International Megan’s Law will not halt child sex trafficking and could result in significant harm to hundreds of thousands of registrants.

“We are grateful for the support of ATSA in our efforts to stop implementation of International Megan’s Law,” stated CA RSOL president Janice Bellucci. ATSA is an international organization dedicated to preventing sexual abuse through research, evidence-based practice, public policy and community strategies that lead to the effective assessment, treatment, and management of individuals who have sexually abused or are at risk to abuse.

A hearing date of March 30 was requested when the motion was filed. The federal government’s response to the motion is currently due on March 4, however, both dates could be postponed if the government requests a delay.

    I was looking into CASOMB. Its ranks are filled with law enforcement, prosecutors and of course the now infamous Tom The Scam Tobin. But I must ask, do those CASOMB prosecutors and law enforcement just sit around while their buddy, Tom The Scam Tobin, operates a so called sex offender treatment program while serving as the CASOMB “vice chair” (which I will just assume, given his leadership title, that Tobin is second in command). Tom The Scam Tobin is clearly in conflict of interest. But with Tobin’s buddies in law enforcement/prosecution, Tobin is clearly (and troublingly) protected with impunity. This is a clear case of our government officials engaging in, or at least enabling, corruption. I was hoping that Florida would also creat its own sex offense management board to help research and advocate for more fair laws. But after reading and seeing the mess that they have in California, with Tom The Scam Tobin at the helm, we are probably much better off without an equivalent to CA’s CASOMB disaster.

      Regardless of whatever contrary finding, Tom Tobin is in conflict of interest. Pure and simple. It just shows how government is so corrupt as to allow this blatantly obvious conflict of interest to continue for what appears to be OVER A DECADE. A double standard and evidence of the “anything goes” attitude when it comes to either dirty government contracts and (or) the sex offender ‘treatment’ industry. I hate to join mobs in villifying others, but this Tobin person just seems like a pathetic crook. I mean how can a person have the gall to impose unscientific methods on people under the umbrella of conflict of interest?

      Personally, I’m just interested in seeing the bidding process to how Sharper Future won its CDCR contracts. It does seem very strange that the vice chair of the California Sex Offender Management Board also happens to be the CEO of Sharper Future. This clear conflict of interest sure seems illegal. With all the negative things being said about this Tom Tobin character (along with all his efforts at lies and manipulation), we should all be demanding accountability from our government officials. We should not tolerate double standards.

    Almost 30 yrs ago I was in Tom Tobin’s “treatment” program (if I can even call it that). You see, he along with Mary Perry Miller ran another scam hilariously called The Center for Special Problems in San Francisco. There were many times in group that people would criticize the sex offender registry. Tom Tobin would personally defend the registry, shut us down, minimize the collateral effects of the registration penalty and make it seem like it was a failure of ourselves to not take responsibility for our crime. I am guessing it was his advocacy of suspect treatment tactics and registry laws that ultimately won him friends in law enforcement that has led to the current (bogus) CDCR contracts his new Sharper Future program has. I was a young 20 yr old back in the 1980s. Looking back, Tobin’s program was completely demeaning and not necessary. About 30 yrs later it seems strange that he now makes himself out to be a psychologist for the easing of harsh laws. Don’t buy into Tobin’s conniving manipulation!

    There are a lot of people complaining of Sharper Future. Has anyone bothered to file a complaint with the California Board of Psychology or California Board of Behavioral Sciences?

      Indeed a very concerning program run by a bunch of fraudsters who use scam science like the lie detector. I remember talking to their so called “clinician.” He listened and said what seemed to be comforting and nice things (which really was just a sugarcoat of reality). The at the end of the “therapy” session, he says: “By the way, you are setup for a polygraph test in a few days.” Then he coldly hands me a slip to sign and washes his hands. Sharper Future is a disgusting and unethical program, funded by the corrupt CDCR budget, that has no other concern than keeping its government contracts. Dr. R, thank you for the link.

      I appreciate the link. I have read through it. It is deeply disturbing that this is the trend of sex offender treatment (IF one can even call it “treatment).

      It just shows you how so much unethical behavior can be justified because of sex offender hysteria. I have personally heard stories about Sharper Future’s clients having their constitutional rights trampled by less-than-qualified “clinicians.”

      People should really be filing complaints with the California Board of Psychology, as well as the Board of Behavioral Sciences.

    Pseudo psychologist Tom Tobin is one of many charlatans that profit from “treatment” that label through the troublingly flawed Static 99 and Static 99R. The Static “instrument” is a big part of a cottage industry that has sprung from bogus actuarial “risk assessments” that venture into the realm of fortune telling. The Static-99R is sometimes correct, but inacccurate and wrong most of the time. Its false-positive flag for HRSO individuals is particularly troubling, considering Tobin — in his CASOMB vice chair position (which clearly pose an unethical conflict of interest with Tobin as CEO of Sharper Future — perhaps having influence in Sharper Future not coincidentally acquiring millions of dollars in state CDCR contracts) — has advocated the Static 99R’s integration in a potential “tiered” registry. A tier based not solely on the objective fact of a crime conviction; but Tom Tobin has the shameless, and unethical, audacity to propose tiers based on foreseeing the future with less than chance accuracy.
