I don’t know what the F@ck going on anymore, so many laws and amendments to Fla. Statues. I have a 1991 conviction and live out of state Can’t afford a lawyer and if I could…I don’t know if he/she milking the cow or giving me an honest answer The State where I am they just want to have guest speakers at some RSO meeting Can’t get a straight answer from any more. I am getting tired of donating money and might not ever get off this crappy Registry. It seems animals have more rights than I do Fighting the registry is getting useless

This is beautifully written. These judges need to get their God Damn act together. This country isn’t going far if they permit this status quo insanity to go on.
Peeling back the onion. Just by looking at the 2018 943.0435 “law,” and comparing it to, let’s say the 2004 “law,” you can see how many onerous “rules” and “restrictions” have been added or enhanced. Nine printed pages in 2018 versus five printed pages in 2004. Most mentionable in 2004 are having to register just once a year, “permanent residence” meant 14 or more consecutive days, temporary residence meant 14 or more days in the aggregate calendar year, and there was no marking of your driver’s license. Ahh, the good old days…..
The biggest change in 2004 was moving the residency restrictions from the sentencing portion of the laws to the registry portion. Back in the old days, residency restrictions were a statutorily mandated special condition of probation aka PUNISHMENT the t only real for the duration of criminal sanctions aka parole or probation. In 2004, they were miraculously converted into something that wasn’t punishment yet was a lifetime restriction. What was most odd was that the STATE has basically admitted the they can’t apply those residency restriction to pre 2005 folks, but they seem to be saying that the gave the cities and counties the right to enhance those penalties, even in the case of folks who were not subject to the new law according to the state. The counties and cities also apparently decided that date of occupancy, not date of conviction or date of offense was the trigger date for their restrictions.
Whoever brings the out of state challenge should consider calling Charlie Christ as a witness as he was AG when the 2004 law was passed and maybe all subsequent AG’s. I remember the Hillsborough County Commission having discussions about the new law in like 2005 and what they could do. They basically decided not to do anything because most of the registrants in the county had obviously been convicted prior to 2004 and the attorneys for the county were concerned that trying to apply the new restrictions to them would be unconstitutional. I am not sure that those attorneys and politicians were any smarter than thoes say from Miami-Dade, but they seemed to be a bit more concerned about the LAW.
I was thinking the same thing these last 2 weeks. The laws for SO are what SP used to be. Some of this new stuff is so ambiguous, I see the chops licking.

Under the color of law, the Floriduh legislature, rubber stamped by the governor, has made permanent rules and regulations of what were once temporary conditions of SO probation. The irony is that many conditions of probation are not retroactive! The registry is de-facto lifetime probation with no relief.
Oh, unless you count the tolling of 25 years, after probation, without having an encounter with law enforcement. Ludicrous! Everyday law abiding citizens not on the registry can’t even do that! Even then, your request to be removed can still be denied, much like groveling at the feet of and kissing the ring of Reich Stadt, now DeSatanist.

Their apology should be in the court room after a monetary award is made to him and sensitivity training with suspensions for them.
Needs to sue the school broard as well maybe can get free college for his children. I would not be asking for an apology the dad needs to hit the purse strings that is the only thing they understand maybe it be wake up call, I am just glad the guy did not have to go to jail or lose his kids

I complied with my FEDERAL requirements: only probation. I was done. How can this state just add to it like that?
