Legislative Update: Notes and Bills

Below are notes on what is currently going on in Florida:

 

 

HB 1179 by Rep. Dan Raulerson (R-Plant City) on authorizing Sheriffs to assess fees for registering “serious sexual felony offender” and for probation and community control.  The bill is on its way to its second of three committee assignments, now in House Justice Appropriations Subcommittee.See also SB 1654HB 1179 by Rep. Dan Raulerson (R-Plant City) on authorizing Sheriffs to assess fees for supervision of probation of certain offenders.

SB 1654 by Sen. Travis Hutson (R-Palm Coast) on additional mandatory imprisonment for some sexual offenders and sexual predators and enhanced penalties for coercing prostitution and for sexting. The bill has three committee assignments and it hasn’t been heard yet.  This bill is DEAD. See also HB 1179.

 

SB 1662 by Sen.Rob Bradley (R-Fleming Island) on sexual offenders. This bill is on the agenda for it’s second of three committee assignments in the Senate Criminal & Civil Justice Appropriations CommitteeSee also HB 1333.

Sexual Offenders; Revises sexual predator & offender criteria; revises reporting & registration requirements; revises elements of offense of loitering or prowling by certain offenders in close proximity to children; revises provisions relating for venue for proceedings for seeking removal of requirement to register as sexual predator or offender; requires that removal of registration requirement not conflict with federal law requirement; revises requirements concerning information to be released by DOC & DJJ regarding sexual offenders being released.

    HB 1179 I am confused as to the status of this bill. It is headed to the floor in the house and still needs to pass one committee in the senate. What can we do to stop this insanity. People that can not make ends meet will now have to pay each time they are forced to register. How can this not be a new punishment? Those on state probation for sex offenses already have to pay for supervision and gps monitoring. Those that can’t pay end up costing the citizens of florida.

      Matt – the bill will likely pass. This is an election year in the state and this BS is the kind of stuff that people eat up like candy and makes for great sound bites.
      You are right, that a “fee” is a punishment. If it passes, we can consider challenging it, but we’d have to weigh the likelihood of prevailing and whether this challenge is more valuable than another we could bring. For example; would a $150/year fine harm us more than registering our wives and children’s vehicles and subjecting them to harassment? Or requiring us to register every URL we communicate through.

        Yes, I agree a lawsuit has to be weighed, BUT…This is a rights violation for those of us who have finished our sentences. I have been put back in the system that I fought so hard to get away from and out of. I did my time. I paid for my crime. The U.S. Constitution “guarantees” that I will not be subject to double jeopardy. So weigh all that when the bill get passed. There are SO MANY others in my same place. Does the Law not matter any more????? We have grounds to fight this continuing imprisonment/punishment on so many levels!!!!!!.

    Funny how the “less government intrusion” party introduces more “government intrusion legislation” than any other affiliated politician.
